How to fill out Household size on Joint-Sponsor & Petitioner's form?

Hi everyone,

I think my situation is quite common but I couldn't find any solution on the internet. Hope someone can help me on this and also other people can benefit from my post!

My US Citizen Wife is the petitioner and I am the beneficiary. We don't have any children. My wife is working part time and full time student, she couldn't meet the poverty guild line income requirement.

Therefore, my US citizen friend Peter is sponsoring on my green card.

1. Is Peter the joint sponsor?

2. When filling out I-864, on Part 3 Question 1 : should my wife check the box "I am the sponsor" & Peter checks "I am the only Joint Sponsor"?

3. On Peter's form, Should I put my wife as the Family member 1?

4. Part 5 of my wife's form: Q1 The number you enter on part 3 line 7 is 1. and total household size is 2

5. And I have no idea to fill out Part 5 of Peter's form..

6. There is no barcode at the bottom of the I-864 form. Is it normal or just my computer's problem?

did you download it from the uscis website?

www.uscis.gov/forms and you can download the i864, check if it has a barcode

1. Peter is single and has no children. But I thought in my case, Peter has to meet the income requirement of 3 people household size? (Which is me, my wife and Peter)

2. Does my wife have to prove tax information too as she filed tax return with her family but her income doesn't meet the poverty guideline.

3. So my wife and Peter's form will basically be the same except personally information and salary?

I just searched some more information on the website which says Google Chrome doesn't show the barcode but IE does. So I tried on IE and it works!!! (The first time to love IE!! )

no, he has to meet the income of his own household size, not yours. so if he is unmarried, that's 1 and you the beneficiary is 1, his household size is 2

yes your wife has to provide the same evidence, even if it's not enough

Peter has another thing he needs to send, proof of being a USC or LPR

1. some of the forms ask for my wife's A-number. Do I still need to put the A-number for her even tho she is naturalized?

2. Form 1-864 Part 4 Q11 : What is the different between US citizen and US National? In my case, which one applies to my wife and to Peter?

3. On Peter's form, Should I put my wife as the Family member 1? No. You go on Part 2, principal immigrant for both the I-864, select yes no 1, no 2 through 6 leave blank, enter "1" in no 7.

4. Part 5 of my wife's form: Q1 The number you enter on part 3 line 7 is 1. Yes, leave 3 to 7 blank, and total household size is 2 Yes.

5. And I have no idea to fill out Part 5 of Peter's form.. No 1, enter "1", leave no 3 to 7 blank, no 7 enter "1", total in no 8 enter "2".

6. There is no barcode at the bottom of the I-864 form. Is it normal or just my computer's problem? Are you using Safari? That may be why you don't see the barcode, I couldn't see it either, but when you download it and open it with Adobe, it's there.

2. Form 1-864 Part 4 Q11 : What is the different between US citizen and US National? In my case, which one applies to my wife and to Peter? Every US citizen is a US national, but not every US national is a US citizen. Anyone born in any US state and some territories, with a couple limited exceptions that I'm aware of, or naturalized is a USC.

A US national is typically someone born in the American Samoa, they are US nationals, but not citizens. Someone born in Puerto Rico, any US state, the Virgin Islands, the Northern Marianna Islands, Guam, and someone who naturalizes is both a USC and a US national. The term USC implies that you are also a US national, the term US national implies you are not a USC.

Therefore, your wife is a USC because she naturalized so she checks 11a. Peter you have to find out if he is a USC, national, or LPR, he checks the appropriate box and he has to provide proof with the I-864.

2. Does my wife have to prove tax information too as she filed tax return with her family but her income doesn't meet the poverty guideline. I'm not sure what you mean here. Was she claimed as a dependent on her parent's taxes? She has to provide her own taxes for the last 3 years if she filed them. If she wasn't required to file, she needs to include a written statement and proof from the IRS that exempts her from filing. Could you please elaborate here?

3. So my wife and Peter's form will basically be the same except personally information and salary? Basically yes because your wife is still your sponsor and has to submit her own I-864 for you even if she has zero income.

I just searched some more information on the website which says Google Chrome doesn't show the barcode but IE does. So I tried on IE and it works!!! (The first time to love IE!! ) Interesting, I never noticed that it didn't show on Chrome either.

Why do I enter no 7 as 1?

Your joint sponsor is single with no dependents. He will put a 1 for you in Part 5 #1 and a 1 for himself in Part 5 #2. That will make a total of 2 in Part 5 #8.

When using IRS tax transcripts, you do not need to include any other tax documents. All the tax info is contained in the tax transcripts.

You said you are applying for a green card. Are you currently in the US and filing for adjustment of status from your F-1 status?

first of all you don't fill out Peter's i864, you fill out your i864 and he fills out his own i864 and signs it

just like your wife, he is sponsoring you . so 1 for the beneficiary which is you, himself is already printed on the form, number 8 is the total, 2

tax transcripts are fine, he also needs proof of being a LPR or USC, letter of employment and paystubs if possible

Because I am asking him for help, so I want to gather as much as information so it won't take too long for him to fill out the form!

Okay so both my wife and Peter have household size of 2.

I will ask him for his letter of employment and paystubs, passport and hopefully birth certificate too.

So for the Q5 in Part 6, I read some resources says USCIS will check if the number is the same as the sponsor's Form 1040. So I have to match 2 numbers? So the current individual income is not really current (Now)?
