Hi, I'm LPR and I would like to bring my 16 years old daughter to live with me in USA. She would be in Grade 10/11 when I register her in a local high school. I would appreciate if anyone could please advice which is the correct application Form and the faster journey to take for her to join me. Thanks.

11/06/14 - I-130 sent

11/10/14- Priority Date

11/12/14 - Notice Date

03/16/14 - Approval Notice

USCIS N-400 Naturalization (GC 07/09/2009)

Lockbox Phoenix, AZ Office FIeld:San Francisco

04/06/15 - Package sent via USPS

04/08/15 - Package delivered to PO Box

04/20/15 - Case accepted, routed to National Center for processing

04/13/15 - Check presented

04/20/15 - Received I-797C NOA

04/2515 - Received Biometric Notice (dd 04/07/2015)

05/08/15 - Biometric Appointment

05/12/15 - Received Notification in line for Testing and interview

06/18/15 - Case updated interview scheduled

As an LPR you file an I130 and have to wait for a via number. The current wait is about 2 years so she will be closer to being a senior or starting college. There is no way to shorten the time unless you can become a USC or are married to one.

This will not be over quickly. You will not enjoy this.

I was in grade 10 when my father started the petition , and i'm now graduated from high school and still waiting for interview .

If you want fast process then consider applying student visa for her , that will be fast.

Waiting time is 1 year or more depending on the Visa Bulletin for F2A category. http://travel.state.gov/content/visas/english/law-and-policy/bulletin.html

Are you married to a USC? Because if you are it would be faster if they petitioned for your daughter.

Yes, I entered USA on K1 visa and I added my daughter (she was 10 y/o then) to our initial petition. However, I wrote to USCIS to remove her because she wasn't ready to come with me back then.

Ok, that's great. Since you married your USC spouse while your daughter is under 18, he can petition for her as her stepfather. The process is much faster than if you petitioned for her. She would receive an IR2 visa. The process takes abbout 6 to 8 months at USCIS, then NVC processing. About a year in total to receive visa give or take a couple of months.

I divorced USC 3 years ago, so I will be petitioning for her.

In I-130 question 14 .. (If your relative is currently in the USA? He/She arrived as...? Arrival Record, Date arrived?

Will it affect the process if she is here in the USA while I submit my petition?

It looks like you should have more than 5 years as an LPR by now and you should be eligible to apply for citizenship. I would greatly recommend that you apply for citizenship, if you are already eligible since it would considerably reduce the wait time for your daughter to obtain LPR. Plus, if you become a USC and your daughter obtains LPR before turning 18, she would automatically become a USC.
