Effect of I 751 Good Faith Marriage Waiver on N400 Application

I married a USC and adjusted my status by I 485. Unfortunately, marriage did not work out and we got divorced after living together for about a year together. At the end of the marriage when we were fighting my USC spouse accused my of marrying them for immigration status and also accused of lying and cheating on them throughout the marriage. When I applied for I 751 good faith marriage waiver I candidly mentioned every detail of the marriage in the affidavit and supporting documents including these accusations. I also submitted pictures, emails, travel, insurances, band account, tax, memberships, cards, gifts etc. I 751 good faith marriage waiver was approved. Will USCIS question me again on my previous marriage and/or readjudicate my permanent green card which they gave me after I 751 waiver approval? Will these accusations or previous divorce lead to denial of N 400, revocation of green card and put me in removal proceedings? Should I be worried? Please advise. Thanks.

I think they check. It is happening to me now. I went through two interviews and no decision made yet. Didn't deny but I am waiting for 33 days as of my 2nd interview in 9/11. I will keep you update.

As you are applying under the 5 year rule, I really don't think it's going to be an issue. I am in a similar situation, and after everything I've researched, i know that when you get to your interview, the IO will ask questions about dates, what happened to the marriage to cause divorce maybe, etc.

Give them nothing more than what they are asking you, no need to say anything about the accusations that your ex-spouse made, i don't believe they'll be interested in that. All they want to do is verify that the info you have provided on the N400 is correct and true.

As for me, when and if, the IO will ask me why I got divorced, I will simply say because I caught my ex-spouse cheating with multiple women. Unacceptable behavior for a married man!

What I will NOT tell them, is that after he got caught he went around town telling the people we met together as a couple, that I married him for papers, so that he could save face and not look like an a** (or the fact that he vandalized my car after we separated).

This stuff they don't need to know and may not necessarily want to know either, I also don't want to inundate them with all this extra stuff.

Thanks Deidre. So basically they will not reevaluate the marriage. They will only ask abiut dates, names etc that I will mention on N400? Thanks again

Exactly right. Coz the whole evaluation of the marriage was completed in order to get the green card now it's just ensuring dates are correct, that you've been here for at least 5 years, etc, you know how to speak & read english and us history, so we can get the citizenship

The officer might ask you questions about your marriage, like dates, his name , maybe his social security number. They can ask as well why did the marriage end (it's up to the officer), you can be superficial in your answer or if you want to you can give a little details. but the officer cannot judge your N400 application over your marriage. Mellions of people divorce and become citizens. So as long as you are telling the truth, you will be ok. Good luck.

I told the truth but I got to go through 2 interviews and no decision made. I/O did not interrogate me but he asked me about children that my ex wife has. Because she cheated and has kid with another man, we divorced. I/O question me why I divorced. I said she cheated on me. I did not tell him about the kid until later part. He asked why didn't you say she has a kid with another man. I replied you didn't ask me how she cheated on me.

I did my I751 without my ex wife and I got my GC. yes I got my GC through marriage. I filed in the divorce and filed my I-751 after that.

I was reserved to tell them everything but it seems like I/O is interested to find out what is going on with my divorce and also why I divorce during my GC application.

Divorce Finalize on Oct 2010, get to know my currently wife on the 2011 march. City Hall on the July 2012. So do you call that immediately?

Don't be worried. Plenty of people have less than straightforward marriages/Green Card applications etc. and you are applying for citizenship on your own based on 5 years of LPR rule. I was divorced and remarried, and sent in the divorce document along with my application, and the Interviewing Officer only asked for the dates we were married and divorced. (it was from over 15 years ago so luckily I reviewed all dates beforehand).

Your I-751 has been adjudicated and you were approved for Permanent Resident and now it's just the step of all documentation for your Citizenship. And they will not revoke your green card and put you in removal proceedings.
