Urgent Help Needed PLEASE

Hello VJ friends

we are facing a major unexpected problem at our process, we have paid our AOS and IV fees and submitted our civil documents in middle september, my American wife ( petitioner ) started a new job and she can not take any vacation before 6 months of starting day (just one month passed ) and that was part of the contract she signed, she suffer from health problems and we requested to expedite our case but embassy denied our request, untill yesterday her health situation got worse and got very sick she went to hospital and they did immaging and bloodwork and ultrasound, she was told that she have problems with her Gallblader and she must remove it as soon as possible, her job wont accept on giving her 2 weeks vacation for medication and surgery and they told her she will lose the job if she will leave although we have medical report and all the documents needed, i care about her health more than job, but losing the job will pause our process, unless the embassy here in my country didnt ask me for recent paystubs during interview.

Please share your thoughts with us, we are totally lost and dont know what to do

Losing job mean nothing really , you can try to find joint sponsors ( friends or family members ) or adding assets ( bank , house..etc )

Just make sure that the total money exceed the minimum requirement in form I-864P.

If you want to go there now then you may try for tourist visa and be truthful with the embassy. ( Explain your situation , i assumed that you want to be with her during the surgery )

Losing job mean nothing really , you can try to find joint sponsors ( friends or family members ) or adding assets ( bank , house..etc )

her salary each month is above the 125%

But with your situation when assets are not enough , you must find join sponsors , even her family members will be able to do that.

The thing is she has to show that she got enough income and without job she can't , which lead to go for the joint sponsor route or assets.

But with your situation when assets are not enough , you must find join sponsors , even her family members will be able to do that.

Without join sponsor or enough assets , it's impossible.

Edit : How about adding money to the bank to make it more than enough ?

They tend to ask employment status , occupation but not incomes.

Or find a new job after medication as soon as possible ? because NVC will process your case normally , the final showdown is in your consulate and by the time you get to interview i'm sure that she will be able to get a new job

Your fiance can not loose her job based on medical condition. She is protected by federal law. That is a fact. Let them fire her and she can sue the hell out of them. Trust me on this. I dont even care if she is under union. Federal law is federal law.

Try the expedite again. With that i am not familiar.

And as for income!!! She only needs to send you last taxes she did. So i assume she dis her 2013 taxes. And if she was good then. No worries about right now.

Dont use her paystubs. Use her tax return paperwork.

In reality Indyial32 most states in the US have an "employment at will" statue which means either the employer or employee can fire/quit at any time for any reason. She just started this job so she is not covered by the FMLA. Many jobs in the US have a probationary period where if you miss work for any reason you lose the job.

A couple of things to note.

1. If the AOS is approved already it is approved. If you have submitted for your IV already, it is most likely approved already. (Note: They normally wont invoice you for the IV without the AOS being completed already)

2. If she is on company insurance, I would say tell her to take Leave Without Pay and just do the surgery so it is done. If they fire her, so be it. She can then go to the Department of Labor and make a complaint. In some states that triggers a regulatory authority to automatically sue for you. Check with your labor department to see if it applies in your case.

Normally the embassy is more concerned if you will become a public burden and not so much about your bank account. Find a job yourself, and get a solid contract set up for when you move. (make sure it says they will keep the position for you pending your greencard / IV being complete.)
