Hi all,

Can I apply for I-131 while my I-751 is pending once I receive NOA letter?

Thanks a lot and please let me know if you need details.

Why? The Conditional (2 year) GC is still valid for travel for 1 year with the NOA letter. You won't need AP to travel.

N-400

Feb. 12, 2016 - Sent N-400 to USCIS (3-year rule)

Feb. 19, 2016 - NOA1

Mar. 14, 2016 - Biometrics

June 2, 2016 - Interview - Recommended for Approval

If you need to travel and haven't received your 10 year green card yet, you just take your current green card, even if it is expired, and the letter USCIS sent you that they have received your application and that your current green card is extended for one year and is still good for work and travel purposes. You just present the letter with your green card when you board the plane to return to the US.

If you did not receive the letter then you can make an InfoPass appointment at your local USCIS office, bring your passport and proof of when you submitted the I-751 petition and they will put an I-551 stamp in your passport, valid for one year. You won't need to use your green card as the stamp in the passport becomes your new 'green card' until you receive your 10 year card.

If it has been over a year or it will be over a year while you are travelling, and your letter will expire, then again, you can make an InfoPass appointment at your local USCIS office, bring your passport, your green card and the letter, and proof of your travel arrangements that show you will be out of the US when the year is up, and they will stamp your passport with the I-551 stamp, good for either 6 months or a year. Once again, your stamped passport will act as your green card until you receive the 10 year card.
