Health Insurance Inquiry

So my husband who came on a K-1.on June 9th of this year I just enrolled for his health insurance through my employer on September 10th (meaning HR got the package with the paperwork on that date). However when my paystub came to me it didn't show him as on my health insurance. I had 60 days to put him on. When the package was received it was day 50 within the 60 day limit. If HR messed up and I have to put him on during open enrollment in november will we face a fine since he was without health insurance for these last few months? And if we do receive a fine will that be a 'violation that could get him deported??" Sorry I know that's a bit paranoid. I hope someone here can answer my questions.

Call up HR and argue with them.

Also says on that page--

"If youre uninsured for just part of the year, 1/12 of the yearly penalty applies to each month youre uninsured. If youre uninsured for less than 3 months, you dont have to make a payment.

Youll pay the fee on your 2014 federal income tax return. Most people will file this return in 2015."

He won't get deported.

I work in HR and calling up HR and arguing with them is not the best solution. Now the part which you would want to know is does your company use a broker to do their benefits or do they directly enroll you. If they use a broker and you have e-mailed your HR Coordinator or have any confirmation that you sent them the enrollment paperwork then they can e-mail the broker and it will be back dated. I would just stop in HR and they should be easily be able to fix this. There have been mistakes with benefits and when it's the companies fault they can call or e-mail the broker and ask for an exception and explain they made a mistake.

The one thing you do want to pay attention to is how they plan on taking the back payments out of your paycheck, if it is a lot of money you can make sure to get with HR so they don't take it all out on one check which can cause financial hardship for some people. Make sure you schedule how you will catch up the back payments on the insurance.

Only your HR can answer the questions about why you don;t see a deduction on your paycheck. They can back date his coverage as necessary, we do it at our company all the time if the error is on our part and not the employee's when it comes to getting it set-up in time.

You can also purchase traveler's insurance if you're SOL for your husband. I did it for mine, while we're waiting for his SSC. Runs me about $60/month but the co-pays are a little heftier than regular insurance.
