Timeline

Hi all,

My husband initially came to the States from Denmark on a K1 visa in April. We were married in June and filed our I485 shortly thereafter. USCIS received it on July 3rd. Since that time our case has been listed in the "Acceptance" phase. He's had his biometrics appointment (end of July), but since then nothing. I'm a little confused by the processing times since, according the the USCIS site, our case is being processed at the Nebraska Service Center and there is no time listed for the I485-Family based adjustment.

We're both just really frustrated and trying to figure out a timetable for when he might be able to work, get a license, etc. Any help is much appreciated!!

Did you also file for EAD?

Hi there,

If your husband had filed for an EAD, he will be able to use the EAD to work and to obtain a driver’s license before the I485 is approved (as EAD approval times are much quicker, typically 90 days or less). Also, you can call your state’s DMV to see if they will accept the I485 NOA document for driver’s license applications. I got my driver’s license with it in Maryland, and although the license was only valid for 8 months it was good enough to hold me over until I got the EAD/GC.

It can be frustrating to track the case progress on the USCIS website. I have learned from personal experience and those of other VJers that the site is not updated as frequently as it should be - for example, my case jumped directly from “Acceptance” to “Card/Document Production”.

I also learned that everyone’s timeline is different, but here is mine to give you an idea of how long it can take (I sent in the EAD/AP forms at the same time as the I485):

Nov 29, 2013: USCIS receives forms

Jan 2, 2014: Biometrics done

Feb 5, 2014: EAD/AP combo card received

Feb 28, 2014: Received letter from USCIS – notice of potential interview waiver case, and to expect a 6 month delay in processing.

July 19, 2014: Green card received

What Blue Crab said. My husband's timeline mirrors his almost exactly and his online status did the exact same thing. We filed in late December and got his greencard July 30. Good Luck!
