Timeline

My wife arrived in the US three months ago on her Tourist visa and was granted a 6 month visitation with me while I undergo chemotherapy here. We are about to apply concurrently for an AOS and Petition of Alien Relative. We have been married and lived overseas for 10 years and have a 5-year-old son (American Citizen, American Passport).

My concern is that her tourist visa (which has a ten year validity) is in her expired passport and the immigration officer at LAX put the number of that expired passport on her I-95 form, as being the passport with which she entered the country, rather than the number from her current passport, which she presented at the same time. Is this likely to cause problems for our AOS/Petition of Alien Relative application and if so, what is the best course of action?

It may cause you problems later on in your immigration process. You would have to get it corrected at a CBP Deferred Inspection Site. See link for more info: http://www.cbp.gov/contact/deferred-inspection/overview-deferred-inspection
