hi all,

im a F1 student, and my husband is a citizen.

I'm going to apply for EAD Card ONLY without applying for a green card.

i think i should put a(9) on form-i765, correct?? my question is

what documents should i provide?? should i provide my marriage certificate? i don't have k-visa because when i entered America i was a f1 student. i have f1 visa, and i-94 and my passport. should i also provide my spouse's passport??

I don't think a(9) applies to you, since you did not come on the K visa. Are you eligible for the EAD without doing AOS - to get the greencard?

April 27, 2016: I-751 mailed

May 2: I-751 received

May ??? NOA1

May 12: Check cashed

May 31: Biometrics appointment scheduled

June 1: Biometrics appointment letter arrives!

June 2: Biometrics walk-in

From what I read on the instructions a9 is for K3 spouses. You wouldn't be eligible for that category if you are an F1.


Refer to section 3 on page 2 of the instructions for students.

Unless you qualify for an EAD under that status, the only other way would be if you have a pending AOS application.


If you file for AOS, you would be able to submit the EAD app without an additional fee.

Under what category do you think you are eligible for an EAD without filing for adjustment of status? (a )(9 ) is for a K-3 visa holder. That is not you. You do not have a K-3 visa. You say you entered with an F-1. There are eligibility reasons for someone with an F-1. Do you qualify for any of those?

Why is it you are not wanting to apply for a green card?

You are not eligible to apply under any category unless you submit it with I-130 / I-485 after getting married. Stand alone I-765 will get denied, regardless of certificates you sent with it.

The only other way to get an EAD card without doing AOS is to apply for OPT [either pre-completion ©(3)(a) or post completion ©(3)(b)]. However, that will only allow you to work and stay here legally with your husband for one year.

12/15/18: Receive notification for biometrics appointment (no date)

12/31/18: Biometrics

02/25/19: Receive interview letter (April 8 )

04/08/19: Interview, approved!

04/12/19: Oath scheduled for April 26 

04/26/19: Oath Ceremony! 🇺🇸

04/26/17:  Sent ROC package

04/27/17:  Package received

05/20/17:  Biometrics letter received

06/02/17:  Biometrics

08/22/18:  Card being produced

 

AOS from F1 visa:

08/16/14: Sent AOS package: I-130, I-485, I-765, I-131

08/19/14: Package received at Chicago Lockbox

08/22/14: Acceptance confirmation text messages/emails

08/22/14: Checks cashed

08/26/14: Hard copies of NOA's received in mail

08/27/14: Biometrics appointment notice received. Scheduled for 9/8/14.

09/08/14: Biometrics

11/14/14: File service request (Day 88)

11/24/14: EAD/AP approved (Day 98)

12/01/14: EAD mailed

12/03/14: EAD received

03/12/15: Status changed to Testing & Interview

04/16/15: Interview, no decision

07/17/15: "Your card is in production" email!

08/07/15: Card mailed

08/10/15: Card received!

~11 months, 3 weeks & 4 days from filing to green card in hand, no RFE's~
