Timeline

Alright guys, I've heard a few very troublesome things around this sight about reasons for getting denied... and I wondered how common some of them are!

First off, I heard my fiance can be denied if I'm not above poverty level, even if I have a cosigner! I am about 9k lower than poverty level but my cosigner is making nearly 4x poverty level, and is offering us housing until we get on our feet, for up to 4 years! will they really deny him for something like that O.O?

also someone mentioned that if My S.O. isn't fully educated he may get denied, my fiance dropped out of high school his senior year. we were going to get him a GED while here but I'm freaking out that he may not make it here to get it!

finally we tried to enter the states a year before we applied for the fiance visa, we knew you needed an AOS.... but we had no idea about the k-1 visa, because of this he was denied and we went back, I studied there for a year and we decided to give it another shot. will they deny him for "trying to enter the USA illegally"? even though we didn't even know it was illegal at the time?

I'm just so worried he'll get a humorless interviewer with a stick up their butt and a vendetta against the world and we'll be screwed over by something simple like that... is it possible :clock:

05/16/14 - Received the ENTIRE packet back in the mail (wrote the wrong number on the check) 12/20/14 - AOS Rejected (wrong amount on the check & a missing signature)

05/17/14 - Filed AGAIN 12/27/14 - AOS sent in... again
05/23/14 - NOA1 Received 01/05/15 - NOA Received

07/22/14 - Left my Fiance to move back to the states for School :cry: (morning) 01/27/15 - Request for Initial Evidence received (wrongly filled out our I-864's)
07/22/14 - NOA2 Received (evening) 02/02/15 - Evidence sent in.
08/12/14 - Case Forwarded to Embassy 02/27/15 - Biometrics appointment (drove 1.5 hr for a 5 min appointment! :protest:)
08/21/14 - Forms & Checklist Received (went to our old address and our ex-roommate threw it out :ranting: ) 04/03/15 - Request for Interview appearance received!

08/26/14 - Forms & Checklist Printed out from the interwebs and sent to Montreal... stupid roommates... 05/08/15 - Interview :clock:

08/28/14 - NVC Status tracker says "Updated" 05/06/15 - Approval!! :dancing:

09/02/14 - Packet 4 Recieved! 05/11/15 - MyUSCIS says Card production has begun

09/15/14 - Medical Interview 05/14/15 - Welcome notice received

09/23/14 - Visa Interview 05/18/15 - Green Card received

09/23/14 - Approval :dancing:

09/26/14 - Visa "In-transit" via DHL

09/29/14 - POE

10/23/14- Marriage (L)

1. I don't know of any education requirement for K1 visa.

2. I don't see why you couldn't meet Affidavit of Support with solid co-sponsor.

3. As for the illegal entry attempt, unknowingly or not,

I'm not certain on what impact, this will have on your K1 filing.

I believe you'd be fine with the co-sponsor. I mean, the whole reason they allow co-sponsorship is for people who can't meet the minimum requirements on their own... otherwise, if being below poverty automatically got your denied, why would they even have co-sponsors in the first place? The only thing that might be an issue is that there is a time limit on how long they will be "supporting" you.

I've never heard of an education requirement. Were there even any questions regarding education level on the forms?

It's hard to say whether or not the previous attempt at entering the country will affect your chances. I wouldn't worry about it too much, though. It's not like Canada is a high-risk country, and you are doing it the right way now. I do have a friend from Canada who was booted from the US because of a stupid teen prank and even he was eventually allowed back in. You might have to provide a written explanation of the event before they approve you, or go through an interview during the AOS process, but I wouldn't think you'd be flat-out denied because of it.

1. If you meet the criteria for Affidafit of suuport you are fine. If for some reason you didn't meet you would be giving a paper and a window of time to get another co-sponsor.

2. The education level you speak of is just one of the fraud indicators. Doesn't mean just because you are a MBA and he is a high school drop out you will be denied. It can just be a red flag.

3. I don't know what you are talking about he needed a AOS to cross the border? Canadians need nothing but I believe a passport and ID to cross the border yes they get denied all the time and sent home. That's not crossing illegal.

I believe you are worrying needlessly. If you are a real bonafide couple and have evidence to show such you should have no worries.

Canada has no issues with co-sponsors. You are fine OP. Nothing you have listed is an issue at all so dial down your panic you will be fine.
