Hi All,

New to the site, and new to the whole process....

My question and background is

Once my K1 visa is approved and I move to the US and get married, I know I need to file for a I-765 to allow me to work, which can be done when I do my AOS I believe.

The company that I currently work for, has offices in both the US and the EU. Currently I get paid out of the EU side of the business and work in the UK. The company has said they will allow me to move my job over to the US and allow me to get paid through the US (unfortunately, going the work VISA route is not an option)

What options do I have to allow me to continue earning between filing the I-765 and it getting approved? (as it can take up to 3 months)

Would I be allowed to work remotely in the US, if I am still getting paid in the UK?

Also, I've seen conflicting information about traveling whilst waiting for my AOS, are there any restrictions that would/could cause problems?

You cannot work IN the states until you have your EAD which you apply for with AOS.

I'm not sure about what you mean by living in the states and still being paid in the uk.

Also you cannot leave the states until your AOS is approved (and have your green card) but you can apply for advanced parol if it is an emergency to leave the states.

I am going through the same process now. Once you get to the US n get married,you will have to get a social security no..(SSN) n please wait till 14 days after coming to the US to apply for SSN, once you have your SSN you will have to file form I485 (AOS) n you can choose to include form I765, it is prudent you do both at the same time, because now you won't be charged for I765. then it will take up to 9months to get the Documents depending on location of filing...me it has been 2months n my Authorisation to work is gonna come in this Month n AOS hopefully next month.

Dont make a mistake of working in the US on a visa because if found out, that is reason enough to be deported, and too, I don't think any firm can risk being closed down by employing someone who hasn't been legalized to work, the only favor you can do yourself is make sure you hasten your process by getting married immediately n applying for SSN after 14days of your coming to the US and once you get your SSN card, immediately file your I765/I485 n other doc lick advance parole/travel doc but I'd advice u not to file Advance parole as even having the doc isn't reason to be readmitted back into the US, they may deny you re-admittence. So save yourself the trouble unless it is very necessary. When you are waiting for your SSN, fill out form I485/I765 and make sure to use the very same info as the one you used on your visa application, as any discrepancies are grounds for denial...

Also ive seen someone telling you that you can travel out of the US once you get your 2yr conditional green card. The thing is you can't, you will have to have an advance parole to do so, you can only travel on your unconditional 10yr green card which you get after being in the US for two yrs n 90days prior to the expiry of the 2yr green card you file another AOS to lift the conditions and a catchy thing is you have to be married to the same person who sponsored your visa, you are exempt from this if you were mistreated by your spouse n you divorced and can provide evidence.

You can help yourself by reading about this topics online...ive spent all the time since May when I came here to research on all this, and it is really hard n boring but come prepared to not drive or work for not less than three months...it took me three months before i could get a driving licence, and too be prepared for a good long boredom unless you like sitting around n doing nothing, but try to work underground.

The whole thing about advance parole that without it. if you do leave you will probably be denied entry, with it you will be more than likely re-admitted. Advanced Parole exists for a reason. Not just to create paperwork for you.

Michaels7 is also very wrong about not being able to travel outside of the US with a two year conditional green card.

The two year green card holder has all the rights and privileges of the ten year card holder.

Like all green card holders, if you are outside of the US for an extended period of time of over 6 months they may consider you have abandoned your residence.

The conditions refer to Marriage requirements, and removing those conditions at the end of the two year period.

You're no more likely to get denied re-entry with an AP card as you are with the two year green card or the 10 year green card. All are permission to travel and re-enter. Only citizens of the USA are guaranteed re-entry. I think you have to do a bit more research, as you've apparently listened to the wrong information here or gotten mixed up about it. There are some cases where AP does no good, but on the typical K-1 marry in 90 days and file AOS traveling on it is no issue at all. And there is zero difference between the rights of a 2 year green card holder and a 10 year green card holder.

The whole thing about advance parole that without it. if you do leave you will probably be denied entry, with it you will be more than likely re-admitted. Advanced Parole exists for a reason. Not just to create paperwork for you.

Not more than likely to be denied re-entry, you will be denied re-entry, as leaving the country without AP before the AOS has been adjudicated constitutes abandonment of the AOS process.

I agree with you disagreeing with me, but they say on their website(uscis) that advance parole does not guarantee being re admitted and too when you apply for the Advance Parole, on the form, you have to fill out the reason why you will be traveling, when you will be travelling, for how long you will be out of the country n so forth, so tell me how you know all this infor before hand, and too it takes 3 months to process advance parole....the solution to this is, wait till an emergency occurs and you have proof tha you need to actually leave before you apply because they ask for evidence, so unless you have evidence n everything figured out before hand dont try this.

As long as your hired in the UK, you can receive your salary here in the US without any problems. You're allowed to stay in the US legally while your AOS is being processed. You will only need a work permit - i.e. EAD or greencard - if you were to be hired in of transferred to the US. As long as you're employed in another country you can work from home here without prejudice.

Harpa, n the rest who say my post is wrong, can you get to the USCIS website and read all the fine print, i have been through this and I know, and for the original poster of the question don't be misled, i have attached the two forms can you go through them and tell me if am wrong

Only USCs are guaranteed reentry. AP has as much chance of being denied reentry as a person who is LPR.

You also say that a person who illegally works will be deported, and that a person can't travel on a 2-year GC without AP. Just dead, dead wrong.

I've read it all.

I agree 100% You're working from home for a company in the UK. You're not hired by a company in the US.
