Anyone have an idea on how much longer!!!!!!!

So my husband is from Guatemala and I am a US Citizen. We were married in April of 2012 and had our son in January of 2013. We filed his I-130 (without a lawyer) in Sept of 2012. We received our approval in July of 2013. The NVC then contacted us needing more documents. We sent in everything except his birth certificate and police records. The NVC told us that he had to go down to Guatemala and apply for those in person. So he left in January of this year (2014). He got the documents and sent them to me, and I turned around and sent them to the NVC. Everything was approved in April of 2014...and honestly I was thinking (Man that was easy).....I WAS WRONG!!!!!!!!

He went to his interview May 22, 2014 and they said that he had everything except an I-601 approval. We have since filed this with USCIS and the lawyer is saying that it will take 6-9 months to get this approved and then another 3-4 months to get a new interview date. Does anyone have experience with this? He has already been gone for 8 months and another year is unfair to our son.

6 months or so seems to be the going time for a waiver, another interview well that depends, how long it took him to get the last one might be as good a guide as any.

that is horrible because the process would have went differently, may i ask why he ended up needing one? anyways the above time estimates are correct. my waiver took 6.5 months for approval and another month for processing visa (from Mexico) but Guatemala is a little slower so after the approval of the i601, he will then get instructions on whether to redo medical and interview or just medical, etc. then i think there it takes a couple of months to get the visa assuming the i601 is approved.

He was here as an illegal and so they said that he had to have this in order to get his visa. WOW 6.5 months.....Well we are down 2 so maybe we will get a wonderful Christmas gift!!!!!!

I would focus more on Easter, there are so many unknowns including Executive Action.

How come you didn't file an adjustment of status while he was in the US?

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

How come you didn't file an adjustment of status while he was in the US?

EWI? (Entry Without Inspection most likely as that would make the spouse not illegible to adjust status)

7/2019-12/2019 (Yes, 16- 21 months) Estimated time to interview MSP office.

Lawyers, are most of the time, just a "dead expense", as they make more mistakes, than they help, and they still charge you thousands of dollars!

Because he was here illegally we couldn't file to change his status, and we were told that we were not going to need the I-601 since the NVC did not ask for it. It is so upsetting to me that he could be here this whole time that we are waiting for this form to be approved.
