Qualified for Child Tax Credit

Hello everyone,

Just a quick question. My children will be entering the US this September. Their father said that he will file for a tax retro for the children. My question is this: Will he be able to get a tax refund or whatever they call it for my children as soon as he gets their SSN? Or should he wait for the filing of tax season? I searched and searches but found nothing relating to what he's about to do. He told me that he will get around $9,000 for our kids once they get to the US. CAN Anyone shed light to this? Will greatly appreciate any response. Thank you.

Tax retro? sound new to me but you can go to www.IRS.gov or http://www.irs.gov/pub/irs-pdf/p556.pdf and there's no such thing as "child retro"

He probably means he is going to amend the tax return for past three years. But how can he claim child tax credit for those years if they were not physically present in the US and living with him?

In order for him to claim child tax credit, the child must be an USC or a resident of the US, Canada or Mexico.

Were your children USC in the last few years? Did they reside in US, Mexico or Canada in those years?

I think he will only be able to claim tax credit from now on, when the children are already in the US and under his custody.

Is he the biological father of the children? Wondering if they were his children in the tax year 2013.

Otherwise they will not be his step-children until you marry him. If you marry in 2014, then he can claim them for 2014 when he files early 2015, but not go back to 2013.

Hi guys, sorry for the late reply.

Well, he is the biological father and our children had lived in the Philippines. They're only going to be US Citizens once they ger to the us. They're IR2. I really appreciate all the response. I'll let him know and have him call IRS. THANKS

What he is planning is tax fraud and can get you all in big trouble. He is claiming a deduction he is NOT entitled to and when caught he will have to repay with large penalties. He will be able to use them for this tax year as long as they are here and you marry by Dec end. Do NOT sign any amended taxes for prior years,

This will not be over quickly. You will not enjoy this.
