Thanks everyone. Seems only way or the best way is get it done before divorce. <_<

Well, hopefully your husband is still willing to sign the I-864 for you before divorce.

Done with K1, AOS and ROC

Thanks Bill! There's no abuse just the relationship comes to end after 8 years. And i don't want to be deported in case if i don't get the kids i will be still able to see the kids within USA. Other hand, If i bring them with me back to Hong Kong, I would like to bring them back USA to see their father and grandparents sometimes.

According to sandranj (Attorney for VAWA)

Weird.. I guess she had a really good lawyer then.. I know that he tried manipulating her using their child.. And also she came on K1.. If that makes difference.

In OP's case, it's untelling what goes behind closed doors... Obviously there's a bigger reason, than just finances, of why he's not filed yet... She's been here long enough.

Thanks Merrytooth. He's willing to sign the I-864 before divorce. Only thing stopping him is he said no money for all the forms. That's what upset me these few years. Cause i can't work till he can get that done for me.

Signing I864 doesn't mean the marriage is in good faith

Imagine how awkward their interview would be? "Oh yeah, we're in love.. Blah blah" and then file for a divorce a week later... Never mind lying to IO

I think he will still willing to go to the interview with me even will be a bit awkward. Can i somehow get everything aside but somehow EAD done? So i will be able to get him some money for all the forms. :(

You get an EAD 30-40 days after you file for AOS. It's only valid for 1yr. You have to have grounds for filing EAD. Unfortunately, overstayed mother of two, is not one of them :( Edited by UK_Fan

Thank you so much, UK_Fan! :)

You are welcome! I wish you best of luck. I, myself, hate uncertainty and can only imagine what you're going through.

Trying to adjust status based on marriage when you know the marriage is ending may be considered immigration fraud.

I'm assuming that you live on or near a navy base, as you are still married and living with your husband. This means you should have access to JAG for legal advice. Make an appointment, go and see them. If you believe that a divorce is imminent, it's even more important to go for advice so you know what you are/may be entitled to.

AR11 filed: 02/05/11

I-751 filed at Vermont Service Center: 02/07/11

RoC Interview: Not required

Gosh, what a difficult situation! How come you believed your husband when he said he could not come up with less than $1500 over a half decade time period, the money absolutely necessary to hold his family together by sponsoring his wife's green card?

One post advocating illegal immigration activity has been removed. Please remember that this is someone's real life you are discussing and that she deserves the respect of accurate ,legal and useful information, not something that is going to cause her even more problems than she has now.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
