Hello,

If you're talking about the child being out of school or not working after graduating, that doesn't affect his petition or visa in any way. Is that what you meant?

yes it is what I mean but the child is above 21 and may comes under cspa act

Ok. Then that wouldn't affect his visa in any way. However you did mention in your first post the he is F2B, not F2A? If he is F2B meaning that he was petitioned after he turned 21, then the CSPA doesn't apply in that case. Could you please clarify?

yes it is f2b visa it is applied by my grandfather for my mom and I am a beneficiary and my father is not alive my mother only takes care of me

Ok. I understand. Your mother is the principal immigrant and you are the derivative immigrant traveling with your mother. I just wanted to make sure.

Therefore, if you are protected by the CSPA you would be fine so long as you don't marry. I'm not sure how the CSPA works, but if they told you that you are eligible for it, your age shouldn't cause you to be denied a visa.

Other than that, there is no requirement that you go to school and/or work in order to get a visa approved.

I'm not sure how the formula works, but it has something to do with when you were petitioned and how long the process took by the time you applied for a visa. They will be able to let you know if you qualify. Good luck!

You would have to contact the NVC to make sure. In any case, the consul should know whether you meet the requirements of the CSPA and decide to give you a visa based on that.

Schooling/graduation has NO effect on your visa application.

To determine if you are covered by CSPA, google CSPA calculator.

The dates needed for the calculator are:

- Priority Date (found on the NOA1),

- Approval Date (found on the NOA2),

- Date of birth (beneficiary),

- Date the PD becomes current (check the Visa Bulletin http://travel.state.gov/content/visas/english/law-and-policy/bulletin.html ).
