08/19/2014: Executive Action for Immigration Administrative Fixes May be Released Right After the Labor Day?

• Business community is looking forward to seeing its proposal for recapture of unused immigrant visas. Read on.
• There are some readers who were not able to read this report because the Wall Street Journal required subscription. For the employment-based immigration system fixes, it appears that business giants have pushed hard for the two reforms included in the executive action. One was to take out spouses and children from the employment-based immigrant visa annual limit and the other was to recapture unused employment-based immigrant visa numbers. There is no information that the executive action will indeed include these two fixes, but its impact on employment-based immigration community will be substantial and tremendous. As this reporter wrote yesterday, unused immigration visa numbers alone exceed 200,000. As for the spouses and children of the primary employment-based immigrants have been estmated to be close to more than 150% of the numbers of principal immigrants. Combination of these two factors may add upto 200,000 + 350,000? This reporter is not good in math and our math audience should correct this reporter for this calculation. Again, we will have to wait and see to find out whether Obama will go this far in administrative reform of employment-based legal immigration system. Good news is, though, that it is not going to take too long to find out whether this dream can come into the reality. With the opening of the Fall season, immigrants can witness some level of dream-come-true, especially some undocumented immigrants. To them, the sky will look much lofter and bluer and the air could feel much crispier! Oh, Come September, we will love ya!

What's emerged from more than 20 closed door meetings this summer are two potentially significant tweaks to the green card granting process. An executive order might, for example, remove the dependents of green card holders from the official caps, which could increase worker green card numbers to nearly 300,000. Yet another proposal would recycle unused green cards from previous years, which could add 200,000 more green cards to the total number allotted annually.

I believe the removal of dependant is only for EB based categories so that they are not counted towards it. That is because there is heavy lobbying going on for EB based categories and none for Family based. Doesn't make sense. Basically its all screwed up.

• AILA liaison reportedly asked Mr. Oppenheim of DOS the potential impact of such reform on immigration visa cut-off dates and his answer was that it would accelerate cut-offs but cut-offs would still exist in the family-based peference immigrant visa categories, while such fix would result in all of EB visa categories immediately becoming current and continuously remaining current for the foreseeable future. But within a year of two, filing and approval of new petitions could require cut-off dates for some preferences for some countries. Interesting.................................................

Only upside i see if EB dependants are not counted towards the quota is that DOS will stop spilling over 10000 visas from FB to EB every damn year since EB will always be current.

According to this article from Latino Post, Obama's executive action on immigration will also include families of immigrant by actually fixing the backlog issue.

The option to use executive action has been encouraged by national organizations seeking common-sense immigration reform. We Belong Together Co-Chair Andrea Mercado is in favor of Obama exercising executive action to improve the immigration situation. Mercado said she wants Obama to grant immigrants the right to "remain and work legally" in the U.S.

"We want to protect woman workers on the job and for the president to increase the number of work visas that are given to women," Mercado told Latin Post, adding that Obama should also address the backlog in the family immigration system.
