My fiance just had her k1 visa interview and she wasnt given her visa. She was asked to send a copy of the affidavit of support from the petitoner(me). Because I used a joint sponsor for the i-129f i told her to bring a copy of the joint sponsors info (ex. i-134, recent tax form, w-2, and paychecks) they denied her because she didnt have the petitioners copy of the affidavit of support and so on.

I have everything i need to send her(i-134, copy of last years tax forms, and copy of the w-2's) but i dont have any recent paychecks. The last time i was employed was December 2013. After that, I went to live with her for 6 months in her home country. I just recently came back to the U.S. and started a new job last week. Because I only have been employed for only a week now I dont have any paychecks. What should I do? Should I get a official letter from my new job saying that I have just recently started? I dont have any paychecks from my last job when i was working last year.

Im a little lost. Someone please help me!

The letter should suffice if you don't have your paystubs, it's pretty much one or the other. Just make sure the letter contains the info they request on the instructions. Usually this is your rate of pay, current position, etc. Also don't stress too much since you started a new job, since you are using a joint sponsor. Just make sure you have all of the documents for yourself. This is because even though you have a joint sponsor, the petitioner is always a sponsor even if he has little or no income.

This does not constitute legal advice.

Can your joint sponsor solely cover the financial requirements?

But if you need to also add to the affidavit of support, then you also

need to send your 2013 tax, and perhaps bank statements, etc.

Considering you just started the job, I think the employment verification

letter with you salary information should be sufficient.

Like above poster said, its not a reject.

You guys weren't properly prepared and they are seeking complete information,

so just comply and accept the delay as your oversight mistake.

Best wishes...

thank you for the replies.

I actually found a few old paychecks but they are from July 2013. Should i send her copies of those? or just a letter of employment?

Those wouldn't help at this point because you no longer hold that job. Also they would be too old anyway to be considered. You only have to provide proof for your current job as well as your tax returns and proof of whatever else you need to satisfy the affidavit of support. The official letter of employment is equivalent to the paystubs, just make sure that it's on business letterhead and not a plain letter. Also as I said before you have a joint sponsor and it looks like they accepted his paperwork just fine, so you shouldn't have to worry about having just started this job. The letter is perfectly valid proof of employment for this purpose. Good luck!
