Receiving graduate school assistantship on a Fiance visa

Hi all!

Thanks for your help last time, and I am back with a new question. :) I was recently admitted to a graduate program, and was also offered a 25% TA assistantship along with the tuition waiver. This 25% TA assistantship consists of working for 10 hours a week as a teaching assistant, and receiving a small amount of stipend. I would love to receive this assistantship to help affording the living cost in Chicago.

However, I am entering the U.S. on a fiance visa (the visa was approved last week). I understand that I can only work with a EAD, which I can apply after I get married. I was wondering if I can receive the TA assistantship on a fiance visa. Is the TA assistantship considered working? Do I need the EAD to be a TA?

Generally, scholarships, fellowships and stipends are not taxable if they are just given to you

to cover school related expenses, and they do not exceed the cost of school.

The tricky part comes when they pay you certain portion based on the service you performed,

then it can become taxable.

But best is to check with your school and see if any of those money that you will receive

will be reported to IRS as taxable income.

If they are not taxable, then as far as I know, you do not need USCIS permission to work.

Also, your school should be able to confirm this as well.

Did you apply to the graduate school on F1 visa, and then got K1 visa afterwards?

BTW, you should fill out your timeline so that VJers can understand

your current status more clearly.

It is not a tax issue, for example you can be working illegally but still owe tax.

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

Welp, I can tell you that for a postdoc (stipend-based, not employment), my husband was offered the position contingent upon his showing up with an F1 VISA. The university knew we were planning to marry, and separately gave us the information they needed in order for him to be processed into the system: the EAD. Without that, they couldn't pay him his stipend and he couldn't enroll in classes. YMMV, so talk to your uni.
