Hi There,

So I just joined up. I left the USA and my fiance only 2 days ago (for the second time after being with him for 90 days) and I am having a very rough time. Emotionally torn and stressed out. *sighs*

I am 20, my American fiance 24. We are hoping we can start the K1 process in about 6 months or so, but I am unsure if it would be possible...

He does not earn enough to meet the income requirement at the moment, as he has not worked really for over a year, he has been working with his Father trying to launch family business projects (without making much money). However his Mother works and makes a good salary. He is currently looking for a job, as am I too here in the UK.

His mother has enough money to sponsor us, but does her husband count as a dependant if he is not earning much money at the moment? They file taxes jointly so that makes me think he shouldn't count as a dependant. If that IS the case, then she might have made enough when the next tax year comes around to sponsor my fiance and I do we can start the process.

Another question though, if me and my fiance manage to find jobs and work for the next 6 months or longer... will this be enough to be approved?

Will they deny us even with a sponsor because my fiance has not worked much in the last 2 years? (his family went through bankruptcy several years ago so things have been tough.)

To be honest I am very worried and stressed... I want to see a professional but cant afford it. We are both young and rearing to work - we just want to be together and start our lives together. Being apart is making our lives and our careers very difficult.

You have time before it is needed. You do not send the financials with the I-129F petition, which is filed first and needs to be approved before you can file for the K-1 visa.

If the mother makes enough for her own household size, which includes her spouse, anyone she claims as a dependent on her taxes plus you, then she can be the co-sponsor, if needed.

what kaydeecee is saying is right. Finances does not come up until the Interview (plenty of time). That is when you would fill out an i-134 and give the CURRENT income. By the way welcome to the VJ Forums!

Don't worry. I had similar case as yours. After you have a co sponsor the finances of ur fiance won't be an issue. Your mother in law should be able to show enough finances to support you in your case which she does.

The only thing is since i had to present a joint tax returns for the family of my co sponsor as well, i had to submit an affidavit of support i-864 Form with i864A form of household members. They gave me a 221g for bringing in the i-134 form.

her husband is included in her household size as she is required to count her spouse in the number. he is not counted as a dependent. if she claims anyone else as a dependent, then she has to add them to the count too.

household size - the sponsor, sponsor's spouse (if any), any minor children (regardless of whether or not they live with the sponsor), anyone the sponsor claims as a dependent on their taxes and the intending immigrant (i.e. you).

Don't worry. I had similar case as yours. After you have a co sponsor the finances of ur fiance won't be an issue. Your mother in law should be able to show enough finances to support you in your case which she does.

typically the I-134 is used for K1 visas. the I-864 is used for adjustment of status, which happens after the foreign beneficiary has arrived in the US and married the petitioner. that being said, some consulates do ask for the I-864 when using joint sponsors as it has more "teeth".

however, since the OP will be going through london, then they will only need an I-134 either from the petitioner or from the joint sponsor (if that is what they choose). the joint sponsor will have to show proof of income/assets, which may include their tax transcripts/returns. Dependent in an income tax term. On a tax return, a spouse is never called a dependent. A dependent is generally a child you provide more than 50% of their support. It gives you a tax break. Your fiancé may or may not qualify as their dependent when they file taxes. There is an age cut-off that is extended when adult children are full-time students. The best way to know is ask "do your parents claim you on their tax return"? They will know what that means. A dependent doesn't have to live in your house. It could be a son away at college in another state.

So Household size is husband, wife, any kids that are listed as dependents on the parents' tax return PLUS the immigrant. The first financial form (I-134) you will need is at your interview in London, It has no place to do a household count. It just says to name the people the sponsor supports and indicate partial or full support. After marriage, their is another support form (I-864) that does the household count and it is filed when you apply for a greencard. A fiancé visa just gets you here. You apply for a greencard (adjustment of status) to become a permanent resident and stay.

So now because I am the old lady, and "mother" to all UK people who need help, I have to say more. You have no job and he has no job. What the heck are you two going to live on? It sucks to be poor and live with the in-laws. Everybody comes to resent each other. Medical care is not free like the UK. It is so much more expensive than you can imagine. On a fiancé visa, You won't be able to work or drive for many months.

The buzz you feel from the relationship can fizzle under the pressure of being broke. So do seriously consider waiting until the guy you want to marry has a job and sticks with it. Don't be encouraged to jump in right now just because you have found out all you need is Momma to sign a form whether her son works or not. You can do it and it will be so much better for you if wait a bit like you said in your first post. Get a little foundation under that relationship.

Here are the minimum required costs you will have. It doesn't include mailing, photocopies, passport photos, vaccinations, two trips to London, or moving your stuff over. You can start saving for the cost of immigrating.

K1 London route = $1680 + £290

$340 (USCIS) I-129F petition

£45 (ACPO) Police certificate just before petition approval

£245 (Knightsbridge Doctors) medical exam. Pay at exam.

$240 (Embassy) Visa fee prior to interview. Online pay.

She doesnt make that much. If it was only a household of 3, $24,000 then she could cover it...but that looks unlikely.

If he gets a job, then his "household" count is 2. Him+You.

OP, a young, healthy, and motivated 24 year old in America should be able to make enough money to sponsor you.

Looks like father-and-son business is not going too well. How about your fiancee getting a job?

Even a minimum wage would get him $15,000 per year, and Portland city is thinking about

raising the minimum wage to $9.50, which would get him $19,760 a year.

At this point, he can get a second part time job to make up the difference,

or use the co-sponsor.

Also, you are 20 years old...why didn't you work for past 2 years?

Were you going to school full time?

With no jobs and money, how do you plan to pay for all the visa processing cost,

wedding expenses, and living expenses afterwards? Who's going to put up the

money until one or both of you are ready to take on this responsibility?

You guys are very young, and if you two have true love for each other,

a little bit of wait to get some fiances in order may not be a bad idea.

Also (addressing Mom's household size) I believe age 24 is the cutoff for him to be a dependent on his parents tax return unless he is a full time student. So if he was still 23 on the last day of 2013, they could claim him. If he was 24 on Dec 31, 2013, then they should not have claimed him. And he won't be a dependent when they do 2014 taxes. So I would say he is not a dependent at this day and time for their household count. Meaning... By the time you need an I-864, he will not be her "dependent" as defined by the IRS, even if he depends on her for room, board, an allowance, a car, auto insurance, his phone, and whatever else.

Dependent child cut off is "under 19" or "under 24 if full time student".

Oh really? Well that sounds very good then in our circumstance. Thank you, it would make things much easier if she was able to sponsor us in place of a family friend or someone who isn't a relative.

As for work, yes we are both looking hard. I was working last year before visiting him again (short 8 month contract) and was in education before that. Also, he did work in the past but moved from Cali to Oregon so would need to do expensive re-training to go back into his previous field of work. We will work that out. Either way is is going to find work of course!

So... maybe she will be able to sponsor us after all if HER household size only consists of three (Her, her husband and me). Its all pretty confusing...
