221g. Is that a denial?

On my interview i got 221g and asked me to email them the address of my brother and the address of my fiance s brother cause they live on the same state. Thats their problem.

They kept my passport. I sent the email with what the asked. But i really dont know what the 221g means. Is a denial? Cause it says something about a year. We are soooooo confused.

No, it is not necessary a denial. The 221(g) is asking more for information. Each embassy has different of papers for 221(g). For instance, one of US embassy uses white paper for refusal but other like the US embassy in Jakarta uses white slip as approval.

Just like everybody has been saying, the fact that they kept your passport is a good sign. I don't know why they considered it so relevant that you and your fiance have family in the same state, but it is their job to look at everything, and your job to provide them with the information they require.

You have done that, sent the email through on Thursday. You have to give them a bit of time to look into whatever they need to look into.

I am sure you will be getting an response in the coming week.

Iremise.. keep calm and think positive.. don't dwell on the what ifs.

A shot in the dark here, but I think they're suspicious you're trying to circumvent the waiting times/availability of sibling visas by marrying an American for the sake of being with your brother much sooner. I'm assuming that's not the case, so I wish you luck and hope you get your visa.

As you were advised in your other thread after they have checked what you submitted you could be approved without further

problems. The one year paragraph on the bottom of the 221g sheet is general information and it does NOT say that this will take a year

for you.

No one knows how long it will take as each case is an individual matter.

You just need to calm down there is nothing to stress about at this time !!!

As long as you are truthful and have nothing to hide, I wouldn't sweat over this.

They have the ultimate power, so just comply to their requests.

As for why they issued 221g, based on your first thread,

since your brother married US Citizen and then got divorced after 5 years,

and coincidentally your brother and fiancee knows each other lives in the same state,

they might be suspecting that this could be fraud marriage being setup by

someone that your brother knew (your fiancee).

Since these immigration officials have seen many variations of fraudulent cases,

so I am sure they are trained to look out for certain patterns,

and I can see how they could make those connections to your situation.

I assume that you met your fiancee first, and then your brother was introduced to fiancee later.

But I think this is what USCIS may be suspecting, and they could possibly check

previous phone records or home addresses for your brother and fiancee

to see if they could have met prior to you meeting your fiancee.

If none of this happened, I wouldn't worry too much.

Yes, it's a bummer to slow down the processing a bit,

but we are powerless to these godly immigration officials,

so we just have to be truthful and comply.

However, to clarify, USCIS is not involved at this stage...only the US Consulate Immigrant Visa Unit is involved at this time.

If the case were eventually to be sent back to USCIS the applicant would be notified first and probably asked for more proof of relationship first. After that if the CO in very suspicious she would send it back to USCIS and then its up to USCIS to see if its a criminal issue for the petitioner and/or if the applicant should get a lifetime ban. That seems highly unlikely in this case.

I believe in this case, that the officers are well within their rights to be suspicious. If the brother and the fiancee live in the same city (especially if its a smaller town and not Baltimore or something) then its a very large coincidence.

The OP must realize that simply having close relatives in the USA is going to lead to greater scrutiny. Im not sure why she told them about her brother and fiancee meeting up, and I can see that could be a normal thing of course, but it also could be a red flag.

However, even if they speculate that this relationship was set up initially, it could still be a legitimate relationship now if appropriate evidence was provided.

Its too bad he didn't at least make a trip or two in the last 11 months. I think that would have really helped to show his commitment. Especially if it was a financial stretch. All the better to show true relationship.

You could probably make up for that lack of contact with lots and lots of emails, WhatsApp chat transcripts, logged phone contacts, etc. Its certainly not legally required.....if they met in the last 2 years that is all that is required as we all know.

A 221G is not a denial. OP I think you know that.......I don't think you are confused so much as stressed out. Thats ok too...people here can support you. Almost all of us have had pain and stress during this process.

Anyway, 221G is by far the most common form given out, mailed out, emailed out, at the embassy and can be given out for something as simple as a missing signature, photo being wrong somehow, or (as in my current case), the request for an updated 2013 tax return.

So do your fiancee and your brother live in the same city? I don't think you mentioned that. Good point though...the embassy really should already have this information so I guess they just want to update it.

Im sure you will have your visa if you have a real relationship, if not in a few weeks, then eventually.

I'm not sure why you would start a new thread and ask the same question....you will get the same response all the time. Relax and have some patience. Nobody on this forum can tell you how long AP will take because each individual case is different. Good luck!
