NVC MESSED UP! HELP! AP AFTER INTERVIEW

Hello everyone, this is my very first post on VJ. I need some immediate help on a messed up situation.

I am in the F2A category.

I went for my IV interview in the last week of May,2014 at Mumbai consulate. It was barely few days before the big scary retro. I was hoping to get my visa on spot as everything looked fine. However, I got stuck with 221(g) TAL. Hubby and I are both PhDs in highly technical fields, I always get 221(g) for any US visa for TAL. But they always clear me in precisely 14 days. This time it was different though, because 14 days after my interview put me right in the middle of June retro. I informed the CO about it, but he assured me that my visa was already pending and everything looked totally fine, he just needed to run the check on me. I was not convinced that I was fine, but what could I do?

I came back home. They continued AP. They even finished the administrative processing on June 20, 2014 and sent me a letter, yes an actual letter by courier that I needed to submit my passport as my AP was finished. I was of course delighted and surprised that they gonna give me a visa, so the kind CO probably did reserve my visa number. But alas! After they received my passport the very next day they sent it back to me with another letter that said sorry, visa can't be issued because of retro! I need to wait till my PD is current again.

Okay oh well! Now, today my husband received a package from NVC which had my original civil docs!! It says, in a letter addressed to me that " please carry these docs with you to your consular interview"!

Are they freaking kidding me? My interview was more that a month and half ago! Now, I do wonder,how come they did not say anything to me at the consulate if my original civil docs were not there? I had no idea what NVC had forwarded to them, I assumed they sent everything I sent them. But No, they did not!

What do I do now? How come the consulate issued me 221(g) for TAL and not for missing docs?dont I need those to enter the US when my visa is issued? Do they go inside that sealed IV pack? Someone please enlighten me.

I am just afraid that when my PD is current again, the consulate guys gonna go to gather my docs for the IV pack and then discover again that everything is not there and issue me another 221(g) and delay the whole thing again.

After I receive the docs from my husband in the US, is it prudent to just go and submit the original civil docs in a document drop off location? Or are they not going to accept it now because my visa application processing is temporarily halted because of retro? I expect my PD to be current in October most likely, although not quite sure. My PD is August, 2012. But if it does, I want to make sure the consulate has everything so that they don't 221(g) me again.

Any ideas what should I do?

You have options:

1. Call NVC and ask why they returned your IV package or

2. Go to the Embassy and ask what you should do with the IV package

hi, thanks for the reply. I guess I kind of know why NVC returned my IV package. After the Visa bulletin was punblished in May and the June retro was apparent, my husband requested expedited processing to NVc because of family reasons and it was approved by the consulate on May 16. Immediately my case file was sent over to Mumbai and it arrived in three days. When I saw on CEAC that my case was ready for interview, I called the consulate and I scheduled my IV interview and biometrics over the phone.

Right before the consulate granted the expedite request, my docs were under review at NVC. They had finished reviewing the AOS pack and had not started on the IV pack yet even though I had sent it quite a while ago. They even issued a checklist to me to send it. I called them and told them it was with them, God knows if anyone there keeps track of anything. So, when my file came to Mumbai, NVC had not reviewed my IV pack yet, they had a record in the database that they had received something from me, they just did not note what it was. I guess because of that reason, it was not sent to Mumbai. And eventually someone went through it and sent it back to me to carry it to the interview as my case was no longer with them.

Seriously, I did not think they won't forward my docs if they had not reviewed them! I am gonna email the consulate, it's really not possible for me to just go over and ask as its kind of really far away from my place.

NVC does review the completeness of the IV package but on certain situations like expedites, most likely they just forward it to the embassy due to the urgency. It is the consul who will review the civil docs. An approval will not be granted unless complete and valid civil docs are submitted.

Technically, the IV package should be with the embassy (retrogression or not), not with you. But if somehow its a mix-up, keep it sealed so you can hand it over untouched.

Ah.. It's too late not to open the package. Husband already opened it. But there was no instruction on it not to open and you can't carry sealed envelope inside the US consulate anyway. So, I doubt I need to keep it sealed. It's still with him and he is sending it to me right now. Oh the mess NVC created! It cost me approximately $60 to send it to them by DHL from India, then they send it back to my husband, now he is gonna DHL it to me! I hope the docs survive their long and circular journey all the way around the globe and back.

I just noticed we have similar marriage dates. I was also married within a week of your wedding date:-) but we submitted I-130 paperwork kind of late. I am glad at least some of us F2As got their gc and are with their families right now.

I just wanted to update this thread for future reference in case anyone finds himself/herself in the NVC documents mix up situation and panics like crazy, like I did. Lol. I wrote to the USEM and this is what they replied to me:

"Hi,

In response to your query, we would like to inform you that only NVC asks for the original documents from the applicant to complete their visa files. Once NVC receives all the documents from the applicant, it schedules the interview according to the priority date of the applicant to the respective Embassy/Consulate with all the original documents. Please note that Embassy does not require or keep any original documents of the applicant except medical, PCC from other countries and originaly signed I-864 from the petitioner. Please note that no civil documents(birth/marriage/academic certificates/marksheets) are kept by the Consulate or Embassy. You may bring photocopy of your original documents on the day of the interview at the Embassy/Consulate except the documents which are required in orignals only.
