I-129F Petition Package Questions and Concerns

Timeline

Hello Everyone,

My fiancée, Marine, and I, Santiago, are gathering and filling all the required documentation so that I can file the initial I-129F petition. We have, like many others, questions and issues about how to properly fill the forms.

Background

- I am a US citizen (permanent address in Miami, FL) studying in Germany until August 20th, 2014. I will then be moving to France for 3 months to be with my French fiancée, Marine. We're hoping to get the K-1 Visa before I have to return to the US at the end of the year (November/December).

- We will be doing all the filing from Europe (Berlin and France).

Form I-129F

Questions:

- In the mailing address field, should I use my Miami address, the one I currently have in Berlin, or my fiancée's in France?

- At the end of the form, should I use my European daytime/mobile number or my US one?

- I've read that an international bank draft should work to pay the filing fee. Is that true?

- To which address should I send the I-129F package if I'm doing it from Europe?

Form G-325A

- In the applicant's residence field: both my fiancée and I have lived in several places in the last five years. She has lived at her parents on and off while studying and also in Italy. I have, only in the past two years lived in different cities in Germany, was back in Miami for a month, and at my parents' in Colombia for a month.

Question: What do we do if we don't have enough place to list them all?

- In the applicant's employment field: my fiancée has worked at different places for varying amounts of time. I am currently a student, did not work from September 2012 to September 2013, and worked from 2008 to 2012.

Questions: 1) Again, not enough to list all items. What to do? 2) How exactly do you fill in the employed, unemployed, student progession?

Letters

- In the letters that we have to draft (intent to marry, explanation how we met, and others) is using first and last name sufficient? Or do we also have to use our second last name like it's done in France, for example?

That's it for now! We really want to leave no chance for error so we can be together in the US at the end of the year!

The I-129F should have a US mailing address, as this is where they will send your notice of actions (your NOA1 and your NOA2). I don't know if they will mail it to an international address. On the other hand, you need to be assured to receive any mail that USCIS will send you...especially your NOA2 (you need a copy of that to file AOS). You can use whatever phone number you want to use. USCIS isn't going to call. The funds you use to pay your petition fee have to be US funds and able to be drawn on a US bank.

Bank drafts, cashier's checks, certified checks, personal checks (See Check Instructions below), and money orders must be drawn on U.S. financial institutions and payable in U.S. funds.

The address you use to mail your petition is dependent on what courier service you will use. The PO box address is just a mailing location if you were using standard mail. The physical address (the Lewisville one) is the actual location where your petition is ultimately received, and generally you will mail to this address if you are using something like FedEx or UPS or similar.

About Form G-325A, if you do not have enough space on the form, you can add a supplement sheet and just reference the question on your supplement sheet. You can list your work history as employed/unemployed or how you see fit.

For your letters, you should probably at least use both your last names, but I think you can use an initial for a middle name if you have one. I think that's what I did anyway.
