married filing separately with no SSN

I have amended my tax return from single to married filing separately, but I just received a mail from IRS saying that they can't amend it since he does not have social security number...What should I do now? Should I just leave it and send the mail that I got from IRS When I send my AOS package or should I wait until I amend it to married.. I just got approval from USCIS two weeks ago and trying to check on my status with NVC. I'm just afraid that it will take a few months if I try to amend my tax return again .I thought they dont need SSN if I do married filing separately but why do they ask for it :(



Somebody help !!! What would be the best and fastest way ?

You do not need a SSN if you're filing married filing separately.. Where it asks for your spouse' SSN you would put NRA (Non-Residential Alien)

13th Mar 2014- I-130 Approved
20th Mar 2014- Cased shipped to NVC.

NVC STAGE

28th Mar 14 Case received at NVC
28th Apr 14 Case # & IIN assigned
13th May 14 AOS package scanned into the system
14th May 14 DS260 available/completed.
20th May 14 IV package scanned into the system

12th June 14 AOS checklist- NVC error-

13th June 14 Supervisor review, said she would remove it when spoke to her. (Up to 30 business days).

28th July 14 CASE COMPLETE!!!!

19th August 2014- Medical

5th September 2014- Interview @ London

05th Sep 2014-Interview

05th Sep 2014- APPROVED! Visa Status Issued same day!

10th Sep 2014- Visa in hand

18th September 2014- POE ORLANDO FL! DISNEY!! :dancing:

My CPA prepared it for me and I was not told to write down NRA.I guess that was the main issue. what should I do now? Do I need to amend it again or is it possible to tell them over the phone?

You should use NRA. My amended tax return was amened without any issues as they updated the status from single to MFS (mentioning NRA on SSN field of spouse). It took approx 10 weeks to complete my amended request. Making a call to IRS is useless. I guess you can amend it again.

I included a typed explanation letter with my returns. It was all of one sentence that explained the my wife is not a resident and does not have a social security number. No problems.

I am the USC Petitioner. My wonderful wife Laura is from Scotland.

10.27.2013 ~ Married

01.23.2014 ~ I-130 sent

01.29.2014 ~ NOA1

06.02.2014 ~ APPROVED!!! NOA2

06.05.2014 ~ Shipped to NVC

06.13.2014 ~ Case received by NVC

07.03.2014 ~ Case number assigned by NVC

07.21.2014 ~ Submitted DS-261

07.24.2014 ~ AoS Invoice available, paid

07.25.2014 ~ AoS Invoice shows paid

07.30.2014 ~ AoS package mailed USPS Priority

07.31.2014 ~ Checked CEAC website 47 times

08.01.2014 ~ USPS tracking shows AoS delivered

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
