I can only speak from my own personal experience and knowledge. But, it is my understanding that an American/foreigner can enter the Phil. and get a 21 day, now maybe 31 day visitors visa. For example, I can enter the phil. with or without my phil. wife, get the appropriate visa, and before the visa expires leave the Phil. for just one day and return to the Phil again for the lenght of the approved visa. There is a lot missing in your story. Either your husband is not telling you something or there is something you are not tell us here at VJ. From what you have stated so far, your husband is not telling you everything. Just my opinion.

Best of luck!

The first thing you both need are all the facts. From what you told us, the story does not make sense. An American citizen arrives at your country with a valid US passport, no kistory of overstay and no history of breaking the law and is refused entry. That does not make sense. They had ot have a reason for refusing him entry. What is that reason?

No offense, OP, but is he under AWA (Adam Walsh Act)?

If he is, read: http://www.visajourney.com/forums/topic/431343-philippines-now-denying-entry-to-some-rsos/

If he's not, I'm not sure why they denied his entrance to Manila. There's gotta be something that he's not telling you, or it's just a misunderstanding/ mistake on Philippines immigration officers.

That would do it, but he already got in 3 times. Why now, on trip #4?

From her posts, he must be AWA.

She said her I-130 is pending for 17 months because of a "security check reason," that he has a criminal background, that he as petitioner needs police clearance. So yeah. I guess they finally caught up to him in PI.

That's probably the same question asked by a lot of people under AWA that got denied entrance after their 4th or 5th trips, or maybe more to the Philippines.

According to your first posting he was detained at NAIA because of information that U.S. government sent to Philippines immigration. I would tend to say what USCIS found with his court records was passed on to Immigration in the Philippines and they are not going to allow him in country based upon this.

And being USCIS has been holding your petition for 17 months without approval... I would say something stinks and it isn't the day old mackerel. You may want to ask your husband for a copy of those court records as well.

Is it possible that someone at USCIS was concerned about his past and alerted the Filipino authorities? Perhaps that didn't happen until someone looked at it recently enough to send a RFE.

What crime did he commit 21 years ago?

I think your husband probably knows exactly why he is being refused entry. What crime did he commit and does the Philippines refuse entry to people who commit that crime?
