Best approach for E-2 child

Our friend is an E-2 Holder but her father is the principal E-2.

Is she eligible for a social security number?

Is she eligible for EAD?

What is the best approach for her. She is graduating High School, heading off to college, and was hoping to get a social and work part time.

Does she need to switch to F-1? She doesn't want to pay "international tuition"

If she were getting married and coming to the US on K-1 o doing AOS I'd have all the answers but I don't know anything about E-2

1. She is not eligible for an Social Security number because she is not work eligible and has no other reason to need a SSN. She can get an ITIN.

2. E-2 dependent children are not work authorizes so they do not qualify for the EAD. (See the EAD instructions - E-2 spouses are work authorized but not E-2 children.)

3. She does not need an F-1 student visa as long as she is an eligible E-2 dependent child.

4. she needs to pay international tuition because she is a nonimmigrant (E-2 nonimmigrant visa holder).

She is not eligible for a Social Security card, because she is not authorized to work on the E2 (I assume this is the Treaty Trader E2). She can get an tax ID number so her father can use it on his tax filings, but that's it. Also, no EAD based on the E2. One of the requirements of the E2 investment is that the business generate more than enough to support the principal and dependents -- that's why there's no work permit for the dependents.

She cannot work, even on campus, while in E2 status. She can only qualify for an E2 dependent visa until the day she turns 21, so she will need to keep that in mind, whatever she decides now. And, no matter what visa she's on, she may have to pay the international student rate, BTW -- depends on the school.

What are her plans when she hits 21?

Why do you think E-2 doesn't make her an international student ? Even if she had EAD / SSN (about which you were asking in other thread), that still doesn't make her a resident in any way.

Presumably her Parents will pay her fees, they presumably had a plan for this situation.
