It is a DCF country see this link http://www.uscis.gov/about-us/find-uscis-office/international-immigration-offices

Unless the Philippines has different requirements you need a resident visa and not a tourist visa which seems like what your husband has.

Also if you don't have any joint accounts or a lease I dont know if your application would be accepted.

The Phillipines is not a Direct Consular Filing (DCF) country for immigrant visas. You will need to follow the instructions on your applicable immigration forms and mail the petitions to the U.S.

Please provide details of what immigration forms you intend to submit, then VJ can be much more helpful. A Balikbayan stamp has no bearing and is completely unrelated to an U.S. immigration process.

My bad. I should have had more coffee before posting.

Mods - can someone please delete my posts in this thread so nobody gets confused.

yep, you can dcf, and you dont have to be on a residency visa. extensions or a balikbyan stamp will work.

just filed today, and im just here with a tourist visa and extensions. was a painless process by the way, except that we had to go out and get cash because the cc machine was down.

i took cable bills, water bills, acr i-card, copies of my passport stamps, bank verification letter. i think thats what she took from the stack i gave her.

infopass, can be found on the uscis website, easy to set up an apointment, not 100% necessary, but you wont be waiting in line, in and out.

best if you can use cash, usd, in our experiance. the rate they were using was like 46/1, so we saved over 700 php.
