Filed AOS, but divorcing now.

She wants to stay in the country. But we are divorcing. An attorney mentioned that she can apply for a waiver of the 2 year conditional requirement she be married. Anyone know where this resource is? Thanks.

That is something you should find out then.

If her initial GC has not yet been approved, then the lawyer is wrong.

Not particularity, but shes blackmailing me. And to answer the last person, no. Because they won't accept it. So i'm basically screwed.

How can she black mail you? Unless you've actually done something illegal, she can't. Plus blackmail IS illegal as well. There is nothing stopping you from withdrawing the I-864 except you. Deal with any consequences of your actions, contact only through a lawyer and tally -ho.

"Blackmail" is something scammers use to convince dumb people to do or not do things they don't want. Unless you murdered someone and she had damning proof, remove your support of the I-864.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

How on earth could she be blackmailing you? What did you do? What is she threatening you with?

And who won't accept your withdrawal of the I-864? USCIS will accept that while the I-485 is pending, always.

Your lack of action makes it easy for her to scam you.

We had a yelling match

but that was all mostly because I was tired of being asked about the paperwork 24/7 and asked to send money back to the Philippines.

Then the cops show up, and Im thrown to the ground, and beaten up, taken outside and arrested, with 4 assault rifles at my head, being told "if you move your head will splat on that pavement"

They had broken into the apartment,

simply because I didn't hear them outside..

I had no idea what was going on until I was literally on the floor after hearing my front door go down.

At that time we had long finished our argument.

Seriously with no injures on her, or me, and nothing broken or physical happening.... I have no criminal record...

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

I know you are fed up with all problems with her and want to get over with.

But as long as you let her do and say whatever she wants, she will never stop taking an advantage of you.

She will claim USCIS that her conditional requirement should be waived due to your "violence".

If you help her immigration status, it would end up admitting that you are "violent" ex-husband.

Is it what you really want to do?

Why are you afraid of blackmail? Afraid of being sued by further domestic violence?

Why don't you blackmail her back about visa fraud thing? I'm sure it is her ultimate weakness.

As long as you keep acting like that, nothing would be changed.

Just stay strong and fight for it. Otherwise, you should not ask for any advice on this site.
