Hi guys,

I hope you could give me an answer. My brother ,a green card holder is getting married this week with his long time girlfriend which is on a tourist visa and planning to file a petition for her once they received their marriage certificate.. The question is, since her girlfriend is on a tourist visa she cannot change her name yet here in us, so what name should they put on the application? The girl's married name which appears on the marriage license or her maiden name which appears on her passport?

Timeline

Whichever name she wishes to use after the marriage is the one that goes on the application. If she starts using her married name she will need to carry her marriage certificate with her when she travels using her passport until she can change her name in the passport.

Your brother is aware that as the wife of an LPR there is not an immediate visa number available and she will have to leave prior to the date on her I-94 right?

Yes they are very aware of that.. And she doesn't have plans of overstaying.. Would there be any problem on the processing of her petition because of different name?

Timeline

When you marry you have the choice of continuing to use your last name as given or taking your spouse's last name. Since they will be sending a copy of the marriage certificate which shows both names there will be no problem with confusion. She has simply made the choice to take his last name.

After marriage, they have to file a Report of Marriage at the Philippine Consulate.

Now, if she wants to use her married name, they can file the i130 using her married name. When she goes back to the Philippines, she can renew her passport to married name, that's where the Report of Marriage will come in because its a requirement by DFA. Her visa will be issued to married name. Her GC will also bear married name.

Timeline

Later on, her state I.D. or driver's license will also be married name. She'll save a lot of trouble by doing that rather than filing maiden name, then later on changing to married name.

Regarding her tourist visa, I think the US Embassy can give her another stamp on her new passport but she has to ask them directly to be sure.
