Please help!! married filling singles apply for N-400

Hello im about to apply for naturalization and i im very confuse and nervous, i got married in here in USA in 2011, my wife came with a turist visa and overstay, now im ready to apply for citizenship but my question is ive been filling my tax returns SINGLE, since she dont work, she dont drive ,she dont have a bank account, nothing on her name, no itin, no SSN, we were just waiting for me to be citizen to apply for her green card, but does filling all this 3 years SINGLES will affect my naturalization proccess??

Well probably it will. But you also have to remember that you will need to put all your wife's information into the N400 and one of the questions also asks if you have ever helped anyone illegally immigrate to the U.S. so I would find help from a GOOD immigration lawyer before doing anything. You've created a mess for yourself there...

Hello Birdo, one of the questions also asks if you have ever helped anyone illegally immigrate to the U.S , well she didnt enter this country ilegally , she enter legal with her visa and passport....

If I was you I would get a consultation at least to answer your questions since the N400 application does ask all the details of your spouse - where she lives, is she a citizen of U.S. , resident or what status etc. But in any case, wishing you the best in your journey.

The key issue is you falsified your status by filing single, you should have filed married filing separately. The part of what she means about illegally immigrating refers to her overstay and that your wife is currently in the US illegally and you are aware of this. By obtaining your citizenship, it is your intent to assist her with immigration.

I think it is time to seek a lawyer before you stir up a hornets nest and have to either A. Lie to obtain citizenship OR B. be forced to turn your wife in where they will know you did aid illegial entry of a person... Time to lawyer up first...

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!
