help with I 864 for joint sponsor!! please :)

Hi, Im getting ready to send in my adjustment of status packet. my wife is a US citizen, and we are both full time students. so we don't meet the poverty guidelines. i asked someone else to be my joint sponsor... do i NEED to have his wife file form i-864A? even though im not using her income at all??? or can i just go ahead just with with i-864, and not i-864a?

The I-864A is an optional form. If the spouse does not want to provide their income for sponsorship, then they do not have to sign an I-864A. Be sure the joint sponsor lists his individual current income and provides a copy of his W-2 along with their joint tax transcript(if they filed jointly) to show his individual income for that too. His spouse will still included in his household size on his I-864. If his income is enough for his household size plus the intending immigrant, then he can be the joint sponsor.

I got an RFE for this exact issue. My uncle and his wife file jointly, so the NVC asked her to submit an I-864A as well. This is just my experience, so I'd recommend you submit it if you can as it can't hurt you, but not doing it can definitely slow you down.
