My Fiance is here visiting on a Permission visa. We have decided we want to get married ASAP, she is scheduled to go back in May. Can we get married and apply for a COS or does she have to go back and then apply for a K1??

Yes, you can definitely get married before May then file adjustment of status after. Same thing my friend lives in Cooper City, Florida did. His wife was on a Tourist Visa, before her visa got expired as a tourist they got married and applied for Adjustment of Status and everything went smooth, no problems or trouble.
