Married yesterday on K1, now my new wife wants to leave to go back home.

Timeline

So after 4.5 years of working very hard to get my wife's K1 visa, we accomplish our goal and marry, and today i go home for lunch and she tells me that she wants out, and wants to go back home.

she is from the Philippines and we met 5 years ago when i was working there for ATT. We dated until I left, and started the K1 process when I returned to Texas. I was laid off 3 times and that delayed the process quite a bit.

For the last 4 years she has been angry with me because we weren't married sooner.

2 months ago, it finally happened and I picked her and her 2 dogs up from the airport. It has been a great 2 months and yesterday we were married.

Now she is telling me that she wants to leave and go home, she is bored, hates being at home, refuses to do what it takes to get her licenses and SSN etc, to help herself. She doesnt want to divorce.... but wants to move back to the philippines.

My understanding is that the K1 visa is a one time entry visa and if she were to leave now, even married, she would not be able to return.

Has anyone had any experience with this?

Yes, if she doesn't have AP on hands before leaving the US, I am afraid she can't come back. I know there are some Vjers said that consulate can re-issued their K-1 visas after used it but I think it is only for emergencies. And your wife seems not on 'the emergency thing'.

There is no re-issuing of visa for someone who's already married.

OP, either get divorced and let the wife and dogs move back to her home country or make sure she understands that once she leaves the US with no AOS filed, she won't be coming back until you file I-130 and she gets an immigrant visa.

Yes. correct. I did not think of that part, "they already married "and K-1 visa re- issued option only if they are still not married yet. Thank you for that.

Im reading that thread now.

Ive told her from day 1 that I do not mind moving back to the Philippines with her, but I want to wait until my son, who is now 14 and lives with his mother, turns 18. I want to be around for the rest of his teenage years.

Why did she come to usa then?

I have red a lot of post from filipine women , after they come they want come back to their country.

Everybody who start a k1 visa know that is for move to usa, and stay with her husband at usa.

I can certainly understand you wanting to remain here for your son and that is a reasonable priority.
I find it rather immature of her to be so wishy washy and self absorbed and not even trying to integrate.

This would royally piss me off. One day after getting married. 'What the heck' is all that comes to mind as it is very silly.

I think you made her mad about something she may not be brave enough to verbalize and wants you to figure it out.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

My wife was here on a prior K-1 visa . The marriage was terrible and verbal abuse from her ex . She decided to just go home before AOS was filed . She just got on a plane and went home . She would not be able to return unless her ex filed an I-130 for her . Which he did not and he divorced her soon after . Sad to hear about this and I hope things turn out better for the both of you .
