Thank you Jihana for the reply I have the untranslated copy's and have been trying to translate them to english using textgrabber, but need to find another way to translate them. Yes i'm sure the USCIS will be eyeballing this very closely. As far as an Lawyer??? I have no clue, we started this out along time ago right before she was taken in. And yes it is fairly recent, in fact it is over now and we can move on. Once again Thank you so much! Scott

Scott, You will need to get an official, certified translation, known as a White Book. There's a lot of information how to do it on the China regional discussion pages. I have a friend who is just starting an immigration law practice and is doing some free work. I can check with her to see if she is still taking pro bono cases.

echo: get the white book for the police clearance report , see what it says. If I were in yer shoes, I'd get that first, and get a legal opinion on it, before filing any immigration paperwork.

Thanks PhillyJon for the reply! Now this White Book thingy?? Does she get that from China? and if so, were will she need to go get it? Pro Bono? Free? Is this friend of yours in the usa? I would love to give her a ring and talk to her about this issue and maybe she could look over the doc's. Thanks Again Scott

Thanks Darnell for chiming in! She had told me she called Guz and explained to them about the situation and that she would need to have the waiver forms with her at the interview. I myself need to wait a few months before i can make the trip again to see her (per 2 year requirement) as i have a new job with not quite a year in. So i guess my next question would be, Are the police clearance reports the same as the court documents? Thanks again! Scott

no. court documents are needed for the petition submittal.

police clearance report is needed for the interview day (or NVC doc intake, if CR-1/IR-1 visa chasing)

I suggest police clearance report so that SHE can see what the police say about her.

IMO, even if she was arrested, detained, put on trial, etc etc etc and has court documents to prove that,

if the police clearance report comes back clean or empty, well, her record of whatever was expunged prior.

hope that makes sense? IMO, prior to filing, calling GUZ IV is useless.

Once again Darnell Thanks, OMG! She was crying which in turn got this old fart crying too! It took a couple of days to explain to her but i think she understands now. We are going to go through was this! and with the help of so so many people on this site, I think she and I can do it. Yes i may need some prof. legal advise (maybe)! in do time. So if the clearance report comes back clean or expunged will i still need to submit the court documents for her petition? And what will they say about us not having any communication for the 2 years while she was locked up? Im sure as anyone else would want to know this answer too. Thanks Much Scott
