USC part of binational couple currently exiled in Canada! We are having to prepare the paperwork ourselves as can't afford a lawyer. Anyone can help with Consular Processing?

We are a bi-national same-sex couple that have been together since 1996. We got legally married in Connecticut in 2010. The foreign spouse entered the U.S. in 1994 on a B1/B2 visa. After all these years together, we could finally send our petition to USCIS on July 1 (I-130/I-485/I-765). We have lots of evidence of relationship including joint car insurance (past 9 years), joint medical insurance (past 7 years), joint State income taxes (past 3 years), split-income Federal income taxes (past 3 years), pictures of trips together (past 17 years), etc... Hope the whole process goes smoothly. We consulted with an attorney before mailing the application and he said we were good to go and should be approved for a green card within 2 - 3 months (is that short period of time really the case???).

We wish the best of luck to everyone in the same situation as ours!

Yes, 3 months is not an unusual timeframe for adjustment of status applications. Congratulations and good luck!

Unfortunately, Direct Consular Filing (DCF) is no longer available in Canada. You'll have to apply via the States using the regular IR1/CR1 processing (I'm assuming you're already married). Start by reading the IR1/CR1 guide: http://www.visajourney.com/content/i130guide1

But... congratulations on being able to FINALLY file! :)

Hi! I'm a USC and I've been exiled in the Netherlands for the past 4 years with my EU husband. We got married in May 2009 and on that basis (thanks to the European Union) I was able to live with him in Holland. Our I-130 petition was received on 18 July, so we're in for a bit of a wait. SInce we've waited for 4 years, a few more months will be manageable.

Ik hou van Holland, maar ik wil thuis (Verenigde Staten) gaan!

Good luck to everyone!

I'm so happy for you, Ty! This whole ball got rolling with repeal of DADT, and now our men and women in uniform can finally be treated as equals. It's about time that the ones who fight for our freedom also get to enjoy it.
