AOS sitting at NBC

My husband and I applied for his AOS in early October 2012 after we were married on sept 8 2012.....we are now going on 9 months and are getting frustrated! My husband would like to go back to Bolivia to see his family in August, but we have no idea when we can even expect an INTERVIEW! We have called the USCIS, contacted our senator, gone to the USCIS office in our city and the only answers we are getting is that my husband's case is at the National Benefits Center and that we need to wait. We put in an e- notification not too long ago and received a letter back saying that they are actively processing the case and have to perform additional review on this case which has caused a longer processing time. The letter then told us that if we have not received any notice or decision in 6 MONTHS then we need to contact customer service. Is this a general timeline that they give everyone or should we be expecting 6 months more (on top of the 9 MONTHS we have been waiting) before they reach a decision. It's is getting RIDICULOUS!!! Please help!!!!

He can apply for Advanced Parole (AP) to travel while AOS is pending. According to the guide it can take up to 90 days to get AP approved.

I went through the same thing I was finally approved WITHOUT interview 9 month and 1 day later after the initial filling. Normally k1 visa AOS that take more than 6 month and remains at the NBC facility, takes a lot of time but at least you avoid the interview

We did exactly the same things like you .. and i have exactly the same letters like you ( i have 3 copies, because after the congressman, i sent NBC letter to ask them, so i got the first letter answer from the congressman and on each answer after that says COPY) ... and i drove 2 hours to go to the infopass for nothing so...i just decide to let it go ..nobody can do anything, its going to take as much time as they want so.. find something to keep you busy ... i found a job and doing test for my vocabulary :) i wish luck to all of us:)

Its good to know that we are not alone. My husband's receipt date is October 1, 2012. We put in a service request on June 4. We called last week and they said we have to wait 30 days.

Don't feel bad, we applied in September and have not yet heard anything. You aren't alone, hang in there.

WE applied september 1 2012 - will be at 10 months waiting as of next week. I submitted multiple service requests and had my congressman inquire for me. As per my congressman - NBC is in the process of expanding. They are opening an additional location in Overland Park, KS so they are running a bit behind. hmmm... seems to be a bit more than a bit!

I keep watching for your approval -hoping we will be right behind you! I saw on another thread where an October and a November filer got approved recently so surely we will hear something soon!

As another member already said, he can apply for an Advance Parole. He can do this for free as long as his Adjustment of Status is still being processed.

I got new news from USCIS : -

I did service request On 04/04/2013 , First reply, i got On 06/05/2013 from USCIS,lees summit saying that it will take 9-12 months on this case, this file is at NBC.

Then my attorney did service request at ombudsman's office On 06/03/2013 , Second reply, i got On 06/07/2013 response from the Ombudsman's office saying that my file is at my local field USCIS office And I should get response from them in 30 days.

I did service request On 03/28/2013 , Third reply, Yesterday On 06/25/2013 I got new email from USCIS saying that it will take 6 months on my case and this file is at NBC,lees summit.

I did talk to customer service 2 tir today On 06/26/2013 , Fourth reply, Today On 06/26/2013 that my file was sent to my local USCIC office on 06/15/2013.

I don't understand there system and how they reply back on service request. Every service request coming up with different reply and when ever you talk to customer service they are giving different report on your case. I'm going to make info pass and try to find out that where is my file after 10 months.
