I have already filed for I130 which has been transferred to atlanta office (no light at the end of that tunnel), so now filing for i129F I have the following questions:

  1. 1.I am confused regarding this text from the officical I129 instructions (http://www.uscis.gov...i-129finstr.pdf) Page 3 Section 8
    The life Act requires applicants to apply for a K-3 visa in the country where their marriage to the U.S. citizen petitioner occured. Petitioners should make sure to identify the appropriate consulate, in the same country where they married the alien for whom they are petitioning, in Block 20 to avoid lengthy delays.
    I (petitioner) would be applying for the K3 visa here in US, what do they mean by the applicant applying for it in the country of marriage?
  2. Do I need to attach a cover letter or anything extra to indicate that this application is not for a Fiance but for my spouse. (other than the NOA1 for i130 which I will be attaching)

YOU, the petitioner, do not apply for a visa. The beneficiary does. You are sending in a petition. If the interview for the K3 occurs, it must take place in the country of marriage.

If you decide to go the K-3 route, you send the I130 petition, wait for the NOA-1 and then send it with the I129F, I am sure this is all in the I129F and I130 instructions

The atlanta field office is not processing the cr1s at all. So if it will take then a year or so to get to my cr1 I am willing to take a chance and apply for K3, hopefully it will be processed in NBC and i ll bypass atlanta. In any case I don't see any harm in filing the K3

They will close the form before you even get to interview and you will be stuck with the CR 1 anyways.

I suppose you are right, there is no harm, just saying if the K3 comes through you are looking at the same waiting period... It's gonna take anywhere between 8-12 months from noa 1 to visa in hand no matter what visa. But with that said, we've seen miracles here on VJ some get approved super fast! And on the other end, some get stuck in ap for a very long time.

In this process there is no way of telling, and I don't blame you for wanna try everything!
