Is your wife the USC? All USC's that meet the requirements need to file a tax return, even if living abroad. It is unlikely they will owe anything unless making significantly more.please i need answer to this questions
can my wife pay tax based on her foreign income?
It will be based on their W2 (or its equivalent) if they have a worked a full yearwhat is the 125% level of woking 7.35$ per hour on 9hours per day and 6days a week.how do one calculate ?
Who is the USC? If she is a US citizen she can move back anytime which will strengthen your casecan my wife only move back to USA just after NOA2 approval to look for job as to be my sponsor?
yes although their is a multiplier so she needs to have significant assets. If she made 12K for 9 months work, she may be able to pro rate that to 16K as that is what she will make the next full yearmy wife made 12k last year but did not work for early 3 months last year, can she use bank account balance to make it up ?
You can make the whole process easier with a co-sponsor if possible. All answer and reply is appriciated.

if it is just the two of you, then the household income would need to be $18,912 per year, if I understand the guidelines and the requirements.
Now, if one assumes $7.23 for 9 hours a day, 6 days a week, 52 weeks a year, that comes to $20,638.80 which is well above the requirement.
I do notice that on the forms I filled out there is a place to list other assets, like property you own, I think there was a place for bank account balances, etc... so I would assume that that could figure in to it somehow - but I'm not sure.
Here are the 2012 figures for the majority of the US:
Persons in
family/.........Poverty
household.......guideline
1...............$11,170
2...............$15,130
3...............$19,090
4...............$23,050
5...............$27,010
6...............$30,970
7...............$34,930
8...............$38,890
Source: http://aspe.hhs.gov/.../12fedreg.shtml
So one should take the figure that applies to the number of persons in your household, multiply it by 1.25, and that's the required income, as I understand it.

my wife is the USC,and please do you know the requirement she need ?she makes 1500$ here (abroad) per month, will she qualify for sponsoring me even though its a foreign earned income
It will be based on their W2 (or its equivalent) if they have a worked a full year
she worked a full year
Who is the USC? If she is a US citizen she can move back anytime which will strengthen your case
ok so its no problem with our petition pending with NVC till she finds job ?
yes although their is a multiplier so she needs to have significant assets. If she made 12K for 9 months work, she may be able to pro rate that to 16K as that is what she will make the next full year
she will move to US with all our savings here (4K$)then open an account as she never had and will 4k be enough to make up her 2011 tax ?
You can make the whole process easier with a co-sponsor if possible.
we dont have anyone to help us.she asked every person she knows but no luck and parent were almost out for a year without job

This one is the actual guideline to file the Affidavit of Support I-864 form for IR-1/CR-1 Visa Application I-130.
In addition, if your baby is born in December, the baby is counted in this years returns. If the baby is born January 1 or after (even if it is 12:01am) the baby is added to the tax return 2013.
Hope that helps. God bless and Congratulations on your little one!

Is this realistic to work 6 days a week at 10 hours while pregnant? You keep upping the hours and like WOW. A CO is going to look at this a wonder will the USC be able to maintain that. Just thinking like a CO.

Here i am now what!!

First if she is working here in the US anything over 40 hrs is paid at time and a half if she lives in CA anything over 8 hours a day is pd at time and a half I dont know if other states are that way too but it would depend on where she is living. Although employers are not suppose to discriminate she will be hard pressed in this economy to find one that will give her that kind of hours pregnant or even hire her at all while she is pregnant. But if she works 60 hrs a week she should be making 29,120 or more. Not alot of employers will promise you that you will always get overtime. Alot of the jobs that are 10 hrs a day are only 4 days a week, She will need to do some research on this. But if she can get the job and work those hours she will have more than enough income. But they may look at the base pay which is 40 hrs because OT is not always available.
