I Was given voluntary departure by an immigration judge.i am a father to USC and husband too.
i have my case /petition approved by NVC and soon will go to US embassy for interview.do i need a waiver for overstaying 5 yrs although i have the VD by the IJ?
please advice.because my ICE DO adviced me i neede no waiver..is he right?

Yes, you will need a waiver for the overstay. As you left voluntarily, you will NOT need a waiver for deportation.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
