Hi Guys

A quick question for someone to answer.

This November I will be married 3 years, and continually resident in the USA.
my green card is up for renewal this September,it has been posted off.

My question is....in order to apply for citizenship do I have to wait for the three year
anniversary of getting my permanent resident(green card) or the three year anniversary of
being married 3(three) years to my US citizen wife?

I think I know the answer but just wanted to get clarification on the subject.

Hi Guys

I would check the I-751 instructions to confirm your suspicion.

Your conditional GC's "PR Since Date" + 3 years minus 90 days.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Your conditional GC's "PR Since Date" + 3 years minus 90 days.


Assuming that you got married before becoming a PR. It is actually the PR date and marriage date that matters. You must be married to a USC for at least 3 years to qualify for the 3 year rule AND meet all the LPR requirements of maintaining residence in the US during those 3 years. You need to use the Naturalization Eligibility Worksheet to determine if you qualify. As other have stated, you can apply at the 3 year minus 90 days.

How many times have your current spouse been married (including annulled marriages)?

NOW , my husband have been married before to a US citizen. BUT THE QUESTION IS ....DO I put 2 (past and now marriage to me ) or Do I put 1(divorced) .........

PLEASE HELP !!!!!!!!!!

Hi sorry to jump since I have the same question as OP and just want to be I understand correctly. My wife came here as a K1 in Sept 13, 2009. We had our marriage license in Sept 29, 2009. Dec 22, 2009 her I-485 approved (see my signature for more details). When can she apply for N-400? Does it start count from 9/29/2009 or 12/22/2009? Seem like it start from marriage date? thx

· been married to and living in a valid marital union with the same U.S. citizen spouse for all three years
· the U.S. spouse has been a citizen for all three years and meets all physical presence and residence requirements
· the applicant meets all other naturalization requirements

It is the "PR since" date on her GC that determines the day from which you can start counting. This is probably 12/22/2009 but check her GC to make sure.

If there are no gaps in her residence (she did not leave the US in the first 90 days of becoming a PR and did not leave for extended periods of time afterwards) you would be able to apply earlier than 12/22/2009. In your guys' case this would then be your wedding date as she got approved within 3 months of marriage. Otherwise you need to determine the 3 year residence date using the worksheets others have pointed out.

What's the date on the original 2 year green card? That's when the clock starts. I am assuming it is around 12/22/2009. If the date is 12/22/2009, you can file the N-400 for citizenship on 9/22/2012.

90 days prior to 12/14/2012 you can file. That would be ~09/14/2012.
