Does he have an I-94??

My hubby INSISTS that he was not given any papers upon entry to the USA. But all of the AOS papers are asking for an I-94 number. Is it possible that he wasnt given one?? He entered on the VWP.

Timeline:
January 9, 2012 : Arrived in the United States from Scotland to visit for a few months.
March 23, 2012 : Married in Pekin, IL
March 19, 2013 (almost a year later) : Forms sent into the Chicago Lockbox
March 26, 2013 : NOA1 Reciepts for I-130, I-765, I-485; case accepted
April 4, 2013 : Change of Address reciept
April 10, 2013 : Biometrics appointment notice, appointment sent for April 23rd
April 15, 2013 : RFE for I-485
April 23, 2013 : Biometrics appointment in Naperville, IL. Super easy, no wait.
April 28 2013 : Receipt of Evidence
May 5, 2013 : Interview appointment to be scheduled
May 11, 2013 : Interview set for July 9, 2013

They stopped giving out I-94s a while ago I believe, so it is very likely he does not have one, if he entered fairly recently.

It is usually a card stapled in the passport.

He entered in Jan. So what do we put on his AOS form?? Not applicable?

Actually, it seems that VWP entrants have not been issued the paper I-94 since 2010, because ESTA made the whole process electronic. I would write "N/A (VWP)", or something to that effect. USCIS will know he was not issued an I-94 since he entered under VWP.

My husband arrived in the USA (plane flew into Newark)in November 2011...his I-94 is stapled inside his passport. It's just a small piece of white paper that fits inside the passport.

That is because your husband entered on a visa (A K-1 visa). The OP's husband entered as a visitor on the Visa Waiver Program.

Yes the I-94 still exists. People that come on an immigrant visa still fill out the white I-94 card and get the lower half when they go through immigration.

Visa waiver entrants used to fill out the green I-94W card. (W for waiver). That is paperless now since ESTA. The forms are asking for an I-94 which anybody who is skipping the normal immigration route (getting a fiancé or spouse visa) would not have.

Visa waiver entrants used to fill out the green I-94W card. (W for waiver). That is paperless now since ESTA. The forms are asking for an I-94 which anybody who is skipping the normal immigration route (getting a fiancé or spouse visa) would not have.

Actually, a point of clarification here. All visa entrants still get an I-94, not only immigrant visas. This includes B2's, F1's, J1's, etc. The only people who do not get I-94s are people who do not travel on visas at all, such as the Visa Waiver Program people or Canadian Visitors.
