hi, we are filling the i-130, my wife is the petitioner, she s a USC, we ll apply for a CR1 VISA.
My wife still use her ex family name, she was divorced when we met,and it s the same name she has n her passport
we are curious now, we want to fill the form i-130, we don t know what name t use, her family name,or her ex family name, the name she has n her passport ? thanx

We had the same question when filling out our I-130 petition but we realized later that most of the forms we had to fill out want the family name that you were given at birth. I am the American petitioner and my passport has my ex husband's last name but we put my maiden family name on all our documents. Best of luck to you with your process!

she should use her maiden name which on her birth certificate " her family name" not her surname

If she does not put her ex's name on the form where it asks for her family name, she will have to put her ex's name in the "other names used" space on the form.
