I recently married a US citizen and I'm currently working on a H1-B visa. I read there is an income requirement for the sponsors for I-130 process. Our incomes and savings are very different, last year my income was north of 250,000$ USD and her's was less than 20,000$ USD. However, her current job is paying ~30,000. In terms of savings, I have around 500,000 and she has approximately nothing.

Do you see a problem meeting the sponsors income requirement?

What is the likelihood we will be interviewed? For other questions like photos we have hundreds of photos and have dated for 3 years.

You can use your income toward the requirement as well. Look at the form I-864 and the instructions to sort it out.

I believe most people have an interview.

I believe her income is enough for the both of you without using your income; $18,913 is the income required at 125% of the 2012 poverty guidelines.

If you are worried about income check out the assets section and what you and your partner could do; you can also use a co-sponsor.

If you read the guides on this site they will put you in good stead.

Did you sign a pre-nup? Have you added each other to bank accounts?

I'm asking because if you're married, then I'd say you *both* have $500,000. Unless you happen to be in a non-joint property state.

You can use your income as long as you will be keeping your job once you get a GC.

You will 100% be interviewed. Only K applicants are sometimes not interviewed. Adjusting from an H1-B, it is required.

Separate property rights applies here. It is his separate property in all 50 states. Even in a community property state, it would be his separate property.

The $500000 was not acquired during the marriage or efforts during the marriage, so it is not community property. It was acquired when he was single, so it is his alone.

He can choose to make it community property by adding his wife's name to the account. (Not a freakin good idea in a new marriage.)
