Wifes Passport |

I was just married and am about to file I-130. My question is do we need to get my wifes passport changed to reflect the new married status with my last name or can we do that later and file with her maiden name on the passport?

Hi I had the same question a few months ago and the answer is you dont have to change the passport just because you're married as long as you send them the marriage licence record everything is alright.I hope this info helped you.Have a good one

You can change it later. It would be easier if you change it before you get to the NVC stage because she will have to submit a photocopy of her passport. You should definitely change it before your case is forwarded to the embassy for interview because her Visa/Greencard will be issued in whatever name is in her passport...changing the name on a greencard later is much more hassle & more expensive. Do it while you are waiting for I130 to be approved if you can.

My passport is in my maiden name. My Greencard was issued in the name I used to complete documents associated with my adjustment of status ie my married name. So, you don't need to change the name in your passport, not at all.

Coming on a K1 fiance visa and adjusting status is very different, for the simple fact that you aren't married when applying for the visa, therefore wouldn't be using your married name on the application. With a CR1 you are already married and all paperwork is processed before entering the country. The greencard arrives in the mail a few weeks after POE...it will be in whatever name your passport & visa are in. I have yet to see or hear of any embassy overseas issue a CR/IR1 visa in a name other than that printed in the passport.

we added wife's married name as a page 4 endorsement, from her issuing agency
they signed it, stamped it,etc
