I-130 question

I have a question about the I-130. I am from the US and my wife is from Vietnam. I submitted the application in Aug. 2011 and it was received by Sept. 1, 2011.

My status has been on initial review the whole time until March 22, 2012 I got 2 email with the DS-1200. In that email was a pdf file with an invoice asking me to pay the AOS fee of $88. and it had a DS-3032 form in the pdf. My wife is in Vietnam. I forwarded the email to her and had to sign the DS-3032 form and send it to the address stated in the pdf. I also paid the fee of $88 already. It's been about 2 1/2 weeks since my wife mailed the form to the NVC. My status is still showing initial review.

How long does it usually take for the status to update? Also was my wife sending the form ok or was I suppose to send it? Can someone also tell me what is the next step in this process?

First of all, the I-130 is the beggining of the process, it's the first petition you have to file to start the spousal visa process. According to what you are saying, in USCIS website your status is still in "Initial Review", but you have received email from NVC with the AOS packet...

Ok, if that checks, you were approved in the USCIS, but they haven't updated their website yet. If you submitted an application for e-notification along with the I-130, you should have received emails and text messages in the phone you listed in the form with notification that your petition had been approved. If not, you only will receive a hardcopy in your mail with that notification. I suggest you to find out about that and fill in your timeline here, it will be easier for everybody to understand what's happening to you.

Now related to your other question, it's totally fine if your wife mailed them the DS-3032, most important is that NVC receives it. When they receive and accept it, the agent she has chosen in the form will receive the IV bill and you both will have to work in her IV packet, it basicly has the DS-230 parts I and II but both of you will have to provide more documents to be mailed along with the DS-230.

Keep in mind that according to what you said above, you are currently at the NVC stage, even if USCIS haven't updated your status in their website yet! I would find out about your second notification with approval from USCIS though, we call it here NOA2.

Thanks for your answer. I haven't got any email saying it was approved yet. The latest email I got was the one with the DS-3032. In that email this is what it says.

Did you submit a form with the I-130 showing your email address, so they could email you the approval? If not, have you received an I-797C in your regular mail showing that the I-130 is approved? It isn't the one saying they received the I-130, it should specifically say it's approved. If so, then don't bother checking the USCIS website anymore, as they don't actually have your case. It's at the National Visa Center, which is a completely different part of government (in the Department of State instead of Department of Homeland Security).

In any case, if the NVC has your case now the I-130 has likely been approved by the USCIS, which is a good sign. Read the CR-1/IR-1 guides on this site for some tips to expediate the NVC process. For instance, there's a template on the guide saying how to submit the DS-3032 by email, so that you can get the IV bill quicker. Once that's received and the IV bill is marked paid, you should ship off your affidavit of support package and the immigrant visa application forms to the NVC.

I did sign up for the email notice but I never got any email saying they approved it. The latest email I got was the one I posted above with the DS-3032 form which was in March 22.

The emails I got on march 22 were these 2. subject of the email was "HCMxxxxxxxxxx (ACL FOR NEOPOST DS-1200)(CC)" and "HCMxxxxxxxxxx (PAOSF I-130 FOR NEOPOST DS-1200)"

Hello, I need additional help right now. Can someone please help me. So after what I received in the above post, I just receive another email "aivf for neopost ds-1200.pdf". In this email it asked me to pay the "Immigrant Visa Application Processing Fee Bill Invoice" which is $230. I went ahead and went to the website instructed and paid the $230. The invoice date was April 19, 2012 and I got the email on April 22, 2012. I checked the payment status for my case and this is what it shows "29-MAR-2012 11:52 AOS $88.00 PAID" and "22-APR-2012 19:26 IV $230.00 PAID".

They still have not requested me to send my Affidavit of Support or any other information yet. Since I paid in April 22, I have not gotten further instructions. Am I forgetting to do something or did something wrong or is it suppose to take this long after I pay?

One more thing I forgot to mention, I notice that when sending the DS-230 and the I-864 you can attach it to the email for them. Can any country do it or is it for certain ones only? Also when sending all of those through email, do I just attach the copy of the information they ask for with the email also (birth certificate, marriage certificate, etc.)

You don't have to wait for NVC to send you anything. You can easily download the forms online, and as soon as your payment status already says "PAID" (which in your case is PAID already), you can send off all the documents with their respective barcoded sheets - you can get this from the NVC portal where you paid your bills.

Only certain countries are eligible for electronic (via email) processing, like Canada and Mexico. I believe Vietnam is NOT one of them, so if I am correct, you have to send out everything via postal mail.

Electronic processing is not available for Vietnam, your forms and documentation will need to be mailed to the NVC.
