How long does the appeal process take?

For those of you denied under the adam walsh act, and have appealed how long have you been waiting so far for a response ? How long is the process estimated? Thanks

05-11-2010 Request for Evidence on both the I129F and I130
07-01-2010 Case Transferred to Vermont Service Center
10-20-2011 Contacted Ombudsman
02-07-2012 Case denied after almost 3 years =(
03-07-2012 Appeal Filed!
01-20-2013 Contacted Ombudsman again...

06-25-2013 EOIR Appeal Review

I am still in Visa Processing Limbo (Back ground checks--2.5 years and running)

I wish I could give you an answer

Have you complained to the Ombudsman yet? This is what got my case finally moving, when i filed my complaint i listed all of the service request numbers and steps i had done . You can file it online

Have you complained to the Ombudsman yet? This is what got my case finally moving, when i filed my complaint i listed all of the service request numbers and steps i had done . You can file it online

My lawyer said that it is about 6 to 12 months wait with BIA before someone even opens a file, because they are behind.

We appealed in Jan 2012.

Ok

I am at 2.5 years now that is 12 months then they open the file

18 months of back ground checks

Is 18 months long enough?

I am at 2.5 years now that is 12 months then they open the file

18 months of back ground checks

Is 18 months long enough?

My husband's 1st petition was pending for almost 2 years before they denied us. His 2nd petition was pending for 3 years and they denied us again in Dec 2011. Now we didn't have a choice but appeal... And looks like it will be about a year untill we hear anything from BIA.

That is more than 5 years of waiting only to hear that it is not safe enough for me to live with him and after almost 6 YEARS of marriage and heaving 2 kids together, I need to go back home. That is what I call nutts...

I wonder if anybody had won an appeal yet?

My wife and I just a got a polygraph today and we have an updated psych report, this will be part of our appeal. Wish us luck!

I know this is an old topic but I wanted to put some encouragement in here in case anyone ever searches this topic. Our appeal was sent off in July of 2012 (we were denied due to lack of co-sponsor) and we hired a lawyer, we send our appeal off and early October we received an Approval on our appeal and was issued an EAD card just a few days later. So about 3 months of waiting for the appeal.

I hope this encourages others...I know I was scared it would take YEARS to get our appeal...even our lawyer suggested we just re-file but we chose to appeal and if nothing heard withing 6 mo we would refile...Im glad we chose to appeal!

Our love began in 2010....our Journey in 2012 (January) and now we are at peace until 2014!

Timeline (kinda-- Im not putting exact dates- just months~)

--January 2012-- Sent our I-485 and I-130 packet off :)

--February 2012-- Touch-- Need more evidence.

--February 2012-- Sent more evidence.

--March 2012-- Biometrics and Doctors App (around the same time)

--June 2012-- (BIG PROBLEM) Immigration sent us a 'DENIAL' letter due to not having a sponsor (I thought we didnt need one)

--June 2012-- we hired a lawyer and got a sponsor, got the I-290B Motion to Appeal or Reopen had everything sent off by the end of July 2012.

--October 2012-- OUR APPEAL WAS APPROVED (breath easy, we didn't have to wait too long)

--October 2012-- Work permit sent-- got SSN

--November 26th, 2012-- AOS interview-- Got sent out told to get a translator and new interview date would be sent. :(

--January 8th, 2013-- Second interview...went well but no idea if we were approved or denied....VERY STRESSFUL!!

--January 15th, 2013-- APPPPPPRRRROOOOVVVEEEED!!!!!! (checked on USCIS web site)

--January 18th, 2013-- Card Production Ordered....welcome letter (hard copy) in the mail!!! :)

--January 24th, 2013--CARD IN HAND!!! DONE!!!!!

Your situation is in no way even similar to what IMBRA folks are going through so your post is a bit pointless here.
