my wife and i are doing our taxes and one of my friends told me that the aos and petition for alien resident fees were a tax write off. is this true and is there somewhere on the uscis site where i can show my accountant?
thanks
Your friends are wrong and your accountant is not very good. Get another one. NONE of the expense is deductable. NONE.
source??
None. She is wrong also. No such thing as "other expenses" for immigration costs. Other expenses of WHAT?
Your fees and expenses are not tax deductible.

No it cannot. If you do not know, please refrain from answering.
In the case of the OP where his wife appears to have been already present in the USA you COULD deduct expenses for relocating her (NOT immigration fees) IF she did so for employment purposes AND you itemize deductions (Schedule A) AND the expenses exceed the protion of your income allowing for the expenses to be deducted. Short answer, NO.

I am trying to help you here and I hope I do, but I have to say very clearly, if you have an accountant that cannot answer the very basic questions you are asking you need another accountant. My teenagers could do this. Seriously. If your accountant would need to be shown by the client where to find information on taxes....RUN!!!!!! Run fast!
USCIS would never have any site that has anything to do with taxes. Taxes are handled by the IRS and it would be their site, not USCIS, that would say anything about what can be deducted. USCIS could not possibly care less in a million years about your taxes.

Again. NONE of the immigration fees are tax deductiable for ANY reason. None, zero, zip, nada, NONE. Forget it.
IF she was employed IN THE UNITED STATES and relocated WITHIN the United states, more than 50 miles from her previous address for WORK PURPOSES (not because she married you) and took another job, legally, then the costs of her moving can be deducted IF you itemize deductions AND the expenses exceed the threshhold to be deducted. Read the IRS 1040 guide.
Again, forget about ANY expenses related marrying you, immigration, moving to be with you, etc.
If you wish to keep this person you refer to as your friend, I suggest you not keep him as your accountant.
