Thank you everyone who replied non-judegementally...even tho me and my husband (technically my USC husband would apply as u guys said) are not considering applying for food stamps this really helped in case things get rough and thank you Mod for cleanin' up this thread.

Thanks for that information. This is often a question when the green card holder gets divorced from the USC after adjustment of status. The affadavit of support leaves the USC liable for any means-tested benefits received by the immigrant. But that doesn't mean the state chases down the USC for reimbursement, and apparently many don't. It seems yours does.

Actually we would get hold of the sponsor and hear their story. in one case a church sponsored them, so the church got the bill. In other cases a USC did the sponsoring, but they were out of work or destitute themselves, so in that case we did not go after anything in recovery. But Food Stamps and cash are different animals. Collections for cash abound, but food stamps are rarely collected unless for fraudulent issuance. At least, that's the way it was in my day. Your state may vary, and rules may change as the wind blows.

USC kids are eligible for food stamps.

LPR kids under 18 are eligible without a 5-year-wait but sponsor is still subject to repayment, though there is a law that they can't come after a sponsor to repay food stamps if the sponsor is on food stamps as well.

To keep it simple, you can always apply and then get denied, refused, etc. Check for other relief resources in your area, there are usually plenty of churches or other private organizations who can assist.

I hesitate to participate in this discussion, because we do receive foodstamps. I had been with my fiance in Mexico for about 8 years, and we arrived here at the heigth of the "depression" in June of 2009. There were no jobs for carpenters, or handymen. I knew that I was the only one that qualified for help, and made it clear when filling out the forms, that my wife and three children were immigrants, and did not qualify. I am now employed, and we no longer need them. I want to say that as bad as this economy has been, with people accustomed to making thousands of dollars, and are now on unemployment, is it such a surprise that there are now people on welfare, that have never received it before-hand. This is almost the same for me. I believe that the welfare department knows this, and thinks accordingly.

The poor today have blackberries, ipods, an so on. There was a time people would actually sell stuff they own in order to eat. What a concept. If it came to me being on food stamps I'd sell my computer first because the few bucks I'd get for it will buy a lot of Ramen noodles.
