I called USCIS today to request that our case be expedited, I just received an email saying it was denied after "careful consideration". 5 hours is consedered careful consideration. We have more than valid reasons for requesting that our case be expedited. Are there any other avenues I can take? Should I call them back? Speak to someone hire up maybe? Any help is appreciated.

K-1s are NOT ELIGIBLE for expediting. They make EXCEPTIONS for a US CITIZEN who is in the military and about to be deployed to combat areas OR in extreme medical cases for the US CITIZEN. I have never heard of anything else. If those were not your reasons, "careful consideration" should take no more than 5 minutes.

Financial hardship

Claiming financial hardship in a visa application where you have to prove, TWICE that you can support your fiancee. Great idea.

One thing to remember is that they are mostly concerned with insurmountable hardship to the US citizen. This is what you have to prove. They are not interested in any hardships the intending immigrant is experiencing.

Yes. And THEN you have to prove you can support him.

Financial hardship is on his part not mine. I realize I have to provide proof that I can care for him and that is not a problem. As I said in my earlier posts there are very valid circumstances surrounding this request that I did not want to provide publicly. Financial hardship is what USCIS called it.

I think it has to be extreme financial hardship. I always thought of it in conjunction with the USC. But is does not say that

I was trying to think of a circumstance that could qualify but could not.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
