I-130 Affidavits

Hey ya'll just another quick question.. The 3rd party affidavits that we are going to be sending along with the I-130, does anyone know if they have to have a signature and notarized or is their contact info enough since they arent a MUST?

I can't say for anyone else, but I CAN tell you that I submitted my I-130 with two third party affidavits--they DID include the peoples' contact info, but they were NOT notarized. We were approved with no RFEs.

Well, I guess it depends on whether they get to those or not...an affidavit, by definition, should be notarized and must include the contact/identity information USCIS specifies...of course, your evidence may be so good, they don't really care (and that may be the case...they are considered the lowest level of relationship evidence according to many). I say, if you include them, then get them signed and notarized...otherwise, don't bother sending them.

Well I am hoping we dont need to have them signed. We were thinking we can send them since we want to send them asap, and in the meantime before his interview have them mail us another copy of their letter with their signatures. Which will kill two birds with one stone.. The first being letters addressed to us both and the second the affidavits being signed. I just dont want to get my packet sent back, but I am the type that worries about the anyway..lol..

Another question.. Does anyone know why we need to send a copy of the back of my birth certificate?

YESSSSSSSSSSSSSSSSS !!! Some Birth Certificates have records on back of them and some do not. Mine does not have any information on the back. My sister who was born in another country on US Base, has information the backside of hers. Thus, since the USCIS instructions read both front and back, then I followed. Be safe Rose, and don't take a chance with it. If yours is blank like mine was, then be sure to write your Full Legal Birth Name, (write: Petitioner), and list it as Page 2 of 2 for Legal Birth Certificate; Then, "BLANK ON ACTUAL ORIGINAL DOCUMENT" Intial and date it .... So if they ask you for copy at interview, you will have the exact document you sent in. Up to you, the clock starts when you send in the application and who wants to wait to be with their fiance's or husband / wife because of a delay from an RFE? Prevent any delay that 'might occur' ahead of time. Regarding Notary on Sworn Statement of Affidavit: No, its not necessary to have it Notarized, BUT it must be witnessed, signed and dated with appropriate witness demographics (name, addy and phone#). I've read the same thing here on VJ. I'm guessing it's someone be overzealous in their efforts. I'm assuming that you're asking because the back of your BC is blank, same as mine. I copied only the front and sent them that. If I had anything at all on the back, I would have copied and sent it, but I'm not sending them a blank sheet of paper as evidence. If they send me an RFE requesting a copy of the back, then I'll make a copy and send it to them.

A. If you were born in the United States, give USCIS a copy, front and back, of your birth certificate. NOW, does that look overzealous to you? It came from USCIS! I think if its what they ask for, then we give it to them. Period.

Thanks to both of you for the responses. I do have the same instructions as George, if they are going to make a big deal out of them not being signed then I will have to correct it. As for now all that is done and now on to the pictures we are going to include. Any idea on how much is too much

I included minimal pictures with my I-130. I do have hundreds of picture arranged in a pictorial format with dates and descriptions, along with third party affidavits ready to send to the NVC and for my wife to bring to the interview. That said, it can't hurt to include a few pictures of both of you together, looking like the married couple that you are. I'm told that pictures are minor evidence from the USCIS viewpoint, but more important when you get to the NVC or interview/consulate. My main evidences were our marriage certificate and the baby's birth certificate. Notice in the list of valid evidences that there is an OR between each one, I'd send as many as I had available though.

Would you recommend taping the pictures to some backing card or putting them all together in a zip-lock; we're also thinking of putting dates and locations on the backs of the pictures... do you think it's needed?

Loto told me about this. either front loading for the I-130 or back loading at the Interview with regards to the evidence of bonafide marriage. all i sent was our marriage cert and birth cert for our daughter. everything else will be brought to the interview.
