First you have to tell what was the reason for denial? What did they tell him/her? Did they give her/him a chance for to get the evidence?

The main reason that the interviewing officer gave is we don't have enough evidence to prove the relationship. That is what the Senator's office case worker get replied from the the chief officer of the embassy for the request of a reason of denial. Beside that they don't have any reason that they mentioned. Thanks for the help.

I am sorry to hear that. If that was the case did they give it to you a white paper with a mark on the reason of the denial? They usually give a white paper and the reason of the denial. And in order for you to continue with your process they do explain to you what exactly you need to do. You also mentioned your Congress offices inquire for your case. I think this a great move for your next petition for your fiancé too.

I was wondering how come the counselor did not ask you to bring more evidence in order for your case to continue? They usually tell you to bring more evidence it's not usual for the embassy automatically to denied you. I don't know if they automatically do that. They usually tell you to bring more evidence on the second interview and then they will determine if you qualify.

I sent only a couple of pictures with the initial petition. But My fiancee made all the evidence ready to give during the interview. I hope that was the mistake that we did. However what I am confused now is it good idea to file another petition or just wait and appeal when USCIS send me the paper? Which one better? Thank you for your help.

Yes you are right, the embassy gave us the white paper with a check mark on the potion that says, no enough convincing evidence to show the legitimacy of the relationship. And I think the embassy they don't give the second chance to interview, rather they send the package to the NVC after three days. The problem the embassy sent it in the diplomatic pouch and after 25 days NVC didn't received it yet. And I heard it might take more than three months. So in order to shorten the time, do you advise me to file another petition stating the reason why I am sending it or just wait to the USCIS to send me the paper? thank you for the help and advise.

I'd cancel current petition make another trip and marry and do a I-130 with a LOT more evidence.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Usually with K1's you will end up getting a notice that they have expired so no use waiting on that to happen. Talk about the interview with your fiance and see if there where any missed questions. You need to front load the next petition because they can't deny for anything that is covered in the petition evidence. You can either get married or file a second K1. How many trips to see each other has there been ? There should be at least 2 before the second filing. Be sure to include pictures with friends and relatives and picture spread over as much time as possible. Include copies of you phone/chat records and some copies of snail mail. My first petition weighed 6 pounds and the second one was close to 8 .

This will not be over quickly. You will not enjoy this.

The evidences were around 50 pictures of both of us and family members, phone call records since Oct 2008, >200 pages print out of chat records from facebook and Gmail , postage of the gift I sent her and also western union money receipt are the evidences that my fiancee took to the interview.

Having just gone through this, my suggestion would to be careful. The embassy in ethiopia is very very cautious of short term marriages, they view them as marriages for immigration purposes. You need to be vigilant and stay on top of the USCIS in processing your paperwork quickly especially in the case of a K-1 because they can expire. Whats gonna happen next well, I tell ya 1. your gonna get a Notice of Intent to Deny most likely

2. Your gonna get a chance to respond to a Request for Evidence

3. Send everything. Contrary to popular belief, unless date stamped pictures do you no service

I only sent 4 pictures with my RFE, what they want to see per the immigratin officer at USCIS

is proof of your relationship. some good things to send are: a. Reference Letters from

people who have know you during your entire relationship, make them professional and well

written

b. All your western unions from the money you have sent her over time

c. Phone records

d. Copies of your passport showing you have gone to Ethiopia to visit her

e. A heart felt letter detailing your meeting and current relationship

f. A letter explaining why your fiance wasnt ready for the first interview, take the blame

and say "I should have prepared her better", and due to distance we were not able to share

alot of information.

g. finally a health insurance policy or bank account or anything that you and her share

send proof of it, it helps

After all this you must wait, if they feel you have provided enough info, then they will proceed in adjudication, they are going to do another fbi name check and make a decision, this will take about 60 days from the time that they receive your evidence. Be swift and dont wait till the end of the deadlines they give you, it looks bad, start preparing now, have all papers ready and as soon as you get your NOID read it make sure you have everything and send it out directly. God bless your brother and hang in there, I have been in your shoes. I just got my NOA2 after a long time coming, it just takes strength and perserverence do not let the consulate beat you, remember there job is to prevent fraud, they really do not care about how much you love your fiance, remember this and you will approach this whole process as it shoud be with tenacity, care and caution in some cases. This forum and website is a great resource but dont come here too often you will drive yourself crazy because everyone is having different experience, and dont go the USCIS website to often either because that will drive you crazy too. Stay cool, chill out and remember where your help comes from.... the LORD.

My broda i most greet u for ur advice.. Anyway i was denied of k1 visa just about a week ago.. We were confused and all around the internet they are telling me to tell my finacee to come down to Nigeria and get married and then Fill for the k3 or Cr1.....When i was at the embassy that day,a guy who did the marriage with her finacee in NIgeria was also denied .. Well i am not convinced about the marriage done in Nigeria just because of visa.. We already had our plans ,paid for many things over there and big wedding ... For me we can't married when we dont even know the evidence they need ... I am concerned about our petetion getting expries by december 5th,hope that wont be a problem to us??
